Another Mother Charged - Hot Car Death of Twins

The news wouldn't tell you this but I bet that gal left her car starring at her smartphone and texting. She was too busy looking at those messages from "loved ones" that she forgot about the "loved ones" stuck in the hot car. This has happened before. Just because you can make babies doesn't guarantee that you will be a good mother. It seems to be just another example of smartphone addiction. I see it everyday.

Another example of why anonymous reporting should be eliminated, and anyone found to have intentionally given false reports should be prosecuted.. even good agencies have limited time and limited manpower, and children DIE because 'the authorities' are out on 'wild-goose-chases.'

Prior frequent abuse is an indication that this was intentional; not caused by any distraction.

Relatives knew the children were being abused & neglected, they begged police & Child Protective Services for help; they did nothing.
The mother strapped her kids in her car on a hot day & killed them both.

Child protective services supposedly investigated twice and found no signs of neglect or abuse. So, is it a problem with insufficient investigations? Did someone actually medically examine the children, talk to their pediatrician, interview the older child away from the mother, talk to neighbors?

I've heard of so many child protective services failures. I have to believe that they share the blame.

Just with many other cases where there was a mountain of evidence (besides witness statements) they do nothing.
Doing nothing has become the new normal - much like police at mass shootings.

Throughout Fernandez's eight-month stay with his mother and Aguirre, multiple people reported signs of abuse to social workers with the Los Angeles County Department of Children and Family Services and the Los Angeles County Sheriff's Department. However, Fernandez was never removed from the household. This led to several concerns over the effectiveness and efficiency of social services in Los Angeles County, and ultimately led to four social workers being criminally charged in Los Angeles Superior Court.

Throughout his eight-month stay in the household of Pearl Fernandez and Isauro Aguirre, Gabriel Fernandez was systematically abused and tortured. The abuse included regular physical beatings causing broken bones, being forced to eat cat litter and feces, his own vomit, and spoiled or expired foods, being burned with cigarettes, being shot with a BB gun in various areas of the body, including the face and groin, being pepper-sprayed, being forced to wear women’s clothing, having to sleep bound and gagged in a small cupboard, and having his teeth knocked out with a bat. [6] According to Fernandez's siblings, while Fernandez was being abused, his mother and stepfather would laugh.[6] According to prosecutors, Aguirre was allegedly motivated to abuse Fernandez because he believed he was gay.[7] The abuse and torture extended to Fernandez's siblings, except it was more directed towards Fernandez.[8]

Social Workers[edit]

The social workers associated with the Gabriel Fernandez case were Stefanie Rodriguez and Patricia Clement.[27] The other parties associated were their supervisors, Kevin Bom and Gregory Merritt. [27]

The social workers were accused of neglecting Fernandez and falsifying public records. [27] Calls regarding child abuse concerns began to occur between the years of 2012 and 2013.[28] The first call came in from his teacher (Jennifer Garcia).[29]

Jennifer Garcia’s concern started when Fernandez first asked her concerning questions regarding being whipped.[29] Garcia reported her concerns to the child welfare hotline. [29] Stephanie Rodriguez, a social worker, was assigned to Fernandez’s case. [28] Garcia continued to see signs of child abuse such as a fat lip, pieces of hair missing. Gabriel also claimed that he had been shot in the face with a BB gun[29] Garcia continued to call the child welfare hotline and was told each time that a social worker would check in on Fernandez.[29] However, there was never a medical follow up and every time a social worker would go to Fernandez’s household, she never talked directly to Fernandez and would only talk to his mother.[28]

According to legal scholar Charlotte Hinkamp, there was sufficient evidence of child abuse and it was surprising that the Department of Children and Family Services did not remove Fernandez from his home[29]

The four social workers were charged with two different felonies: child abuse and falsifying public records. [27] However, charges were dropped in 2020 as justices in the 2nd District Court of Appeal ruled that failure to uphold their duties and failure to remove Fernandez from his abusers did not constitute criminal liability for child abuse.

The social workers were later completely exonerated - found not guilty of anything.

C'mon now, I hope that no-one is suggesting this poor mother did this intentionally.. after all according to the other thread with the 5 year old who died strapped in a baby seat ( errrm)... ...it's a common simple memory lapse that one has particularly in very hot weather, where the parents simply forget just for a few hours that they have a child or children...
...it would seem that this only happens in cars and in hot weather... they never seem to forget they have children in any other scenario... not when they're at school, not when they're out playing... not when they're in bed.. but come a scorching day and a hot car.. and sudden amnesia takes place... *sigh*

Off topic - but Win's link on the murder of Sylvia Likens included this: "Several weeks prior to this, Sylvia and Jenny had encountered Dianna in the same park, while in the company of 11-year-old Marie Baniszewski, and Sylvia had been given a sandwich to eat when she mentioned to her sister that she was hungry. Likens remained silent about the matter, although Marie revealed this fact to her family in late September. In response, Gertrude accused Likens of engaging in gluttony before she and Paula choked and bludgeoned her. The pair then subjected Likens to a scalding bath in order to "cleanse her of sin," with Gertrude grabbing Likens' hair and repeatedly banging her head against the bath to revive her whenever she fainted."

Religion-spouting hypocrite demons. And, nobody to save this 16 year old girl. I'm not religious, but stories like this make me really want to believe in a fiery hell.

Back on topic: So, while I believe that some child car deaths may be unintentional - those that are not should be prosecuted to the fullest extent of the law.

Yes, for some....strange.....reason, it never happens in Winter.

Has anyone here turned someone in ?
to any government agency ..... my sister has and they asked her to FILM it then send them the tape....... yes that is right ..... told her if she can hang out for a couple of days to show a pattern of behavior and what photos to get.......

MOST of the kids killed in my home area have had interaction with child welfare agencies and all files said they could not find enough evidence to do something at the time ...... perhap the person who turned people in did not get enough video for workers to leave their office......

Yes - they'll ask a witness to do the impossible, then use that as an excuse to do nothing.
The old, "We were not given sufficient proof" crap.
They can't very well be honest & say, "We really don't give a damn."

Around 1990, I changed jobs & my former employer tried to cheat me out of $1,600.00 in pay.
I went to the Labor Board & was given a required complain form to fill out. When I handed it to the employee, he looked at it & said,
"What do you want me to do?"
I said, "What do you mean? I'd like you to do what you're required to do - what you're paid to do."
He said, "Well, your boss isn't going to pay you, so what am I supposed to do?"
I said, "Maybe if you call him, he might realize he won't get away with it."
He said, "Nah, I'm not going to call him."
I said, "I guess you're paid to do nothing."
I took the claim form, went home & wrote to the councilman of my district.
A representative from the councilman's office called me a week later & told me to go back to the Labor Office & the same guy will help you.
I went back there & he called my former employer while I was there. I couldn't hear what he said, but after he got off the phone, he told me to go to my former employer & he will have a check for me for the $1,600.00 he owed me.
