Anyone Ever Deal with Workmans Comp?

I fell at work two times within about 6 weeks. Both times I was tripped. The first by another person and the second my foot got caught on something. Both times I went down on the same knee but the second fall was harder, my glasses flew off my face. I filled out incident reports for both but after the second fall I've been having nerve pain down my legs. It's not severe but it's there.

I'm afraid to do any workmans comp claim. Afraid I'll end up injured and labeled. I may just go to my MD or wait and see what happens. Anyone ever make a claim? In talking to people at work who have had injuries, work always seem much less than supportive including the medical staff.

Sorry to hear you've gotten hurt on your job. Falling is falling whether you fell over an obstacle, person or piece of lint. Seriously, it's great you've filed the incident reports. And, yes, please do go see a doctor. Mention to him/her that you were hurt at work. It's a relatively easy process to file for Workers Comp--at least in Montana. Each state may be different. I would expect all doctors', chiropractor's and physical therapist's offices are familiar with the necessary forms, billing, etc,

I was hurt on the job very similar to what happened to you. I reported it, saw a doctor and the bill was automatically paid by WC. That was luckily a one time visit with only temporary pain that was relieved after basic RICE (rest, ice, compression and elevation) care. My husband was hurt on the job (cut his hand on saw) and was off work for six-eight weeks. He had doctor visits, surgery, physical therapy and all was covered 100% by WC.

Keep us posted on how your knee is doing.

I worked temporarily for Workmens' Comp here in Toronto and saw most claims being compensated. If you fell because of an obstacle at work, that should justify a claim. Many workplaces are unsafe and full of cords and junk lying around just waiting for an accident to happen. You are entitled to claim and be compensated for a workplace injury, especially since you were not at fault. Just make sure you have copies of all the necessary doctor's documents and bills as well as the incident reports and witness statements if there were any. And if your claim is initially denied, which sometimes happens, make sure you appeal, because appeals are usually successful.

Thanks for your replies. Here in California I would have to go the the workmans comp place of treatment. I wouldn't be allowed to go to my own MD who of coarse I would trust more.

Both times my knee seemed OK. Only soft tissue damage. But the second fall was so hard, I think my lower back was affected. My ankle or foot got caught in some tubing next to a bed. I'm so rushed at my job I didn't noticed. Turned around fast and that was it.

Knees are tricky and once damaged can gradually get worse. Not trying to be negative here, just cautious. I would go to whichever medical provider they offer, rather than let it go and see no one. If this fall is a precursor to future troubles, you will at least have followed up while your are covered by WC.
