It will be interesting to see how this plays out. I think, based on all his pre-existing conditions, he was right to ask to work from home. It all really boils down to whether his employer offered that option.
 
It will be interesting to see how this case turns out. I agree with @dseag2 about his pre-existing conditions being a good reason his request should have been honored. I have been wondering if employers who pushed returning to work during the COVID surge would wind up facing lawsuits if someone caught it and died or became severely disabled.

Or, perhaps if an employer is required to allow an employee to work from home. I'm not sure if that would be feasible with his type of work.
And, could any employee make such a request?
