Homeowner fined $40,000 for a few inches of fence takes HOA to court

Maryland's 2nd highest court issued ruling.
Disputes between homeowners and their condo or homeowners association (HOA) aren’t uncommon, but a Maryland woman said her Board took it too far.

The disagreement involved a fence and its boundaries. And while the fence cost around $8,000 to construct, the litigation that followed amounted to nearly $40,000.

I see the HOA's point of view but they took things too far. They more details on their survey or measurements as well. Should give room for error on numerous things not just this case. But push it and someone will literally make a federal case out of it.
 
I don't like the hoa thing but that is only me. There may be others out there that do not have a problem. I have paid for my own home, I want to be able to paint my color, garden my way, pick out my own fence. Mind you, I am not doing anything crazy to upset my neighbors. I just don't think anyone should be able to tell me that I can't have vegetable gardens on my property. It your town says chicken are okay that should be your option.
 
Yes, that HOA is evil. :devilish: I'm glad the ruling was reversed in Ms Hooker's favor but maybe if she had hired a lawyer in the first place, it wouldn't have gone as far as it did.
 
Yet another reason I have always avoided HOAs.
I don't avoid HOAs, I hate them, and would never live in them. NEVER EVER!!!!!

My ex used to live in one. She got a "warning" that her cat was actually seen looking out the window. She got a $75 fine for starting her electric lawn mower at 11:45 AM -15 minutes before HOA allowable times. All the people rat each other out to the HOA, it's like the Gestapo. And people use the HOA to get even with others, with nitpicky nonsense.
