I'm bummed....have to reschedule my surgery.

I had retina surgery scheduled for Oct. 24th and I had to cancel it today. Bummer. They said I cannot fly for a minimum of two months and as it stands now, I have to be in Seattle for a trial on December 2nd. So I've rescheduled surgery for January.

Of course, the defense attorneys will most likely attempt to postpone the trial like they have repeatedly postponed all the hearings to date and then I'll have to cancel the January surgery. Their most recent ploy was to get three new lawyers who "have to be brought up to speed" so they needed more time.

I hate the legal system. It seems skewed toward the miscreants...….they have all the rights and the plaintiffs have to put up with it.

Bummer, bummer, bummer, bummer...….

Our legal system is pathetic. When our parents died with a will & trust that divided all the property & money, my brother tried to get everything & he had no trouble finding lawyers who took him for $400.00/hr to fight with my sister & I, even though they knew he couldn't win. They helped him drag the probate case for SEVEN YEARS with appeals, delays, etc. just to soak him. He ended up losing his house to pay legal fees & buy everyone out.

Well, the sons-a-beachballs have delayed the trial AGAIN!!! It was supposed to start on December 2nd (of course I've made my reservations....) and I rescheduled the surgery for January 23. which would have given me six weeks for the trial.

So, today, the defense attorneys showed up for a hearing and said, "So sorry, the dog ate our paperwork and we can't be ready by December 2nd" and the #@%!*# judge said, "Hey OK, no prob, you guys! Take as long as you need! Is January 22 a good date for ya?" (well, in more legal terms, of course).

If I don't have the surgery done by the end of January, I have to start the whole procedure over again and it could months before it gets done. ARRRRRRGBGGGHHHHHHH!!!

It killed me to do it, but I had to tell my bro-in-law that I couldn't attend the trial with him. I can't fly for eight weeks or my eyeball might pop. Nope.

Of course, if January 22 comes and they successfully get another 2-month delay......I might be able to make it.

What the hell is wrong with the court system? Apparently, if the judge doesn't grant the delay, and they lose the case (and there's no way in hell they WON'T lose.....the driver blew .16 on the breathalyzer), they can appeal on the grounds that "they didn't have time to prepare for the trial". I guess over 14 months isn't long enough? Are they waiting to see if everyone just "forgets" about it?

That's awful , for you and for your bro-in-law, but you made the right decision.
You cannot just keep putting off your health needs and your surgery, repeatedly.

We live in a society & we need to have laws. Having said that, I'm afraid the law can be a real ass. I have seen it many times. Good luck. Sometimes we have laws when what we really need is justice.

I understand your frustration Jujube and sympathise with you.

American Law is alien to me, I know nothing about it at all and
what I see on the TV is probably wrong, but according to what
you have written here, you are up against some really tricky
people who are trying to get things held up long enough so that
they can get it dropped all together, either when a new method
is thought about, or somebody dies.

Mike.
