The driver said it was race related. When he called 911, he said he was surrounded by cops and they were "all white".

Fleeing police triggers more responders. It was the drivers fault.

As for the stop for mud flaps it's not a petty stop because debris can fly out from underneath the tire sending it into the air and a car windshield. It happened to me when a stone flew out from underneath a truck tire on a 65 mph highway. Lost a windshield and under the deductible amount so I had to pay $300 because a truck didn't have a mud flap.

So the LEO stopping the truck was going to supply a mud flap along w a ticket?

Maybe, maybe, maybe..........all could have been done by mailing a ticket to Western Express. Instead 2 lives are "ruined", perhaps a million public tax dollars are spent unnecessarily, most $$$ going to lawyers, and I guarantee WE sent a driver to pull the load to it's destination w/out a mud flap.

We'd see how quickly this police stupidity would stop if the settlements came out of the police budget and the cops themselves didn't have qualified immunity.

The cause for the stop wasn't the issue. How the stop was handled was.

Also most companies or the CDL/truck driver license holder are responsible for inspecting the vehicle and trailer before a trip. If the driver missed mud flaps did he miss other things like missing or lose lug nuts, a flat or low tire. Or maybe something happened since his trip started he's unaware of. These are legitimate safety issues. He might have even gotten a warning only.

Again maybe, maybe, maybe. Was the driver trained, was driver handed a pre-trip inspection done by others, or maybe he noticed the mud flap and his boss told him to "not worry about it." Why does Western Express get a free pass here? And it still hasn't been proven the trailer was even missing a flap yet.

Supposedly the most dangerous times for cops is doing stops, yet they continue to make those stops even when it's completely unnecessary to insure public safety. Their response has become shoot first, ask questions later, the innocent public be dammed.

While there may be "Organizational liability" under Ohio law in some cases for minor misdemeanors, if this was an MM, it would be hard to impute such to the Carrier company in addition to the driver.
 
The man has hired famed Attorney Benjamin Crump to represent him. This will be a federal lawsuit no doubt citing 42 USC 1983. There is a 2 year statute of limitations to file it.

When they interviewed him he said he was terrified; in fact he called 911 while he was driving. He's a fairly young man. Any person who watches the news has knowledge of the many times Black people stopped for minor motor vehicle issues have been brutalized or killed by cops. I still remember one instance where the driver did exactly what the officer asked him to do but was killed anyway!!!! And he was shot in front of his girl and child!! That the cop released the dog on him after he surrendered with hands up is another example of unnecessary force!

OhioBoy...I hope he and his family sue the bazoobas out of that police department and win!

The failure to stop is the catalyst. He said he did not know why they were stopping him to the dispatch? So what? Stop and find out. The only way to avoid police us to stay home. It would truly be a lawless society if any person could justifiably flee police simply stating they were afraid. If he was "truly" afraid I understand that, but it is no excuse today as body cams cover stops just like this one.

And the Nichols stop involved all black officers. Account for that if race was a factor? I did not say cams stop police brutality. So called deleted or not that is the product of a crooked cop. It is impossible to stop that, period.

I have a question. Say you have were driving down the interstate and that truck that refused to stop to avoid police sideswiped you, rolled your car over and killed your child! Would you be satisfied if the driver said he did not want to stop because he was afraid to? No, you would be greatly angered, right?
 
I'd be greatly angered that a needless attempt to stop a truck over a mudflap was even attempted. The police can end a pursuit at any time they choose when they decide that it's more dangerous to continue than not. The subject to this thread was NOT a threat to anyone.

The police have lost the trust of those they serve because of their own doing and it doesn't matter what color the police are so people flee.

I can't disagree with your post. I've been stopped for a tail light out. I didn't know. So I had no idea at the time why they were stopping me. He told me immediately. I don't even think I got a fix it ticket. I did get it fixed. Didn't want to be stopped again.

I got pulled over for drunk driving about 1am coming home from work. They said I took a right turn too wide which is a classic drunk driver move. I was probably a tired driver. They didn't even walk me through any tests. They let me go. I was clearly not impaired and what I was wearing showed I'd been at work as I stated. Never took that turn wide again however.
