Settlement Won Today in Police Excessive Force Case Which Ended in Death

Maybe police abuse cases like this will stop with these wins that hit the city in the pocketbook.

DENVER (AP) - A federal jury on Tuesday found five Denver sheriff's deputies used excessive force against a homeless street preacher who died in the city's downtown jail and awarded his family a record $4.65 million in damages, a verdict an attorney said should send a message to law enforcement everywhere.

Marvin Booker died in 2010 after deputies shocked him with a Taser while he was handcuffed, put him in a sleeper hold and lay on top of him, apparently in an effort to control him. His family's attorneys said that was a zealous overreaction to the 56-year-old, who was frail and suffered a heart condition. The city had argued the deputies' actions were in line with the department's policies for subduing a combative inmate.

"He didn't deserve what these five sheriffs did to him that night," his brother, Spencer Booker, said, fighting tears after the verdict. "The jury spoke very, very, very clearly that they used excessive force against my brother. Your actions call for consequences."

The three-week civil trial came amid calls for a federal investigation of the department over other high-profile abuse cases that prompted the sheriff's department to make sweeping reforms. Former Sheriff Gary Wilson resigned in July as the city agreed to pay $3.3 million to settle another federal jail-abuse lawsuit by a former inmate over a beating. It had been the largest payout in city history to settle a civil rights case.

The all-white, seven-member jury began deliberating Friday and delivered its verdict just before noon Tuesday.

I don't know about anyone else, but all this recent spotlight on police brutality and eagerness to shoot and kill has me unnerved.. and rethinking if I would even call them. I care for an impaired adult son.. who can at times be unsettling. I wouldn't call the cops for help. I know they would shoot and kill him. I wouldn't take that chance.

I was brought up to trust the police... but I don't now.. and I'm white.. so is my son.. But Cops scare me after all this footage of obvious abuse of power.

I dont get it, the man is HOMELESS but his family gets the money..rediculous.

I used to trust them too when I was young, things were a little bit different then. They were there to serve and protect, and many of us felt comforted by their presence...not anymore. Don't blame you for being concerned about your son, it's a real problem. The man was homeless, but now for no good reason, he is also dead. The family does benefit from the lawsuit as far as financial gain, but they are also making an important statement about the ongoing rise of police brutality in America. I'm glad the family didn't just let this go, too many incidents of excessive force and abuse.

Family and relatives are frequently the beneficiary of a lawsuit such in malpractice or an auto accident etc. Let's face it money is the penalty in a civil lawsuit. It's as much about sending a message as SeeBreeze noted. Maybe some should be used for actual training and classes about the restrained use of force in other avoid at all cost. Too many police use force as a first choice when it should be the absolute last choice.
 
Since no lawsuit for wrongful death can bring back the deceased, the only recourse is money.. AND since the wronged person is dead.. his/her family gets it as an inheritance.
 
Also, the lawyers have to be paid. I think most trial lawyers, once a case goes before a jury, normally charges around 40-50% of the settlement, plus additional monies for taking depositions, typing of transcriptions and bringing in any star witnesses like Dr. Michael Baden would have to be paid. So, after everyone gets their take, the pie has been pretty well eaten.
