Spain on Thursday toughened its r ape laws, pushing through legislation requiring explicit consent for s ex in a move driven by its left-wing government following a notorious gang r ape that outraged the country.

Known as the 'Only yes means yes' law, the bill was given the green light by parliament with 205 votes in favour and 141 against after passing its first reading by lawmakers in May.

It involves a reform of Spain's criminal code that now defines r ape as s ex without clear consent.

Two of the men filmed the assault, during which the woman is shown silent and passive - a fact the judges interpreted as consent.

Defined by the absence of violence or intimidation, such an offence carried lighter penalties - but no longer exists in the reformed criminal code.

That initial verdict led to huge nationwide protests demanding reform.

In 2019, the Supreme Court overturned the verdict, convicting all five of r ape and increasing their sentences from nine years to 15 years each.

'At last our country legally recognises that consent is what needs to be at the centre of all our relationships,' said Equality Minister Irene Montero.

'No woman will ever have to prove that violence or intimidation was involved in order for it to be considered a s exual assault.'

Until now, r ape victims needed to prove that they had been subjected to violence or intimidation.

The new law also tightens the rules on street harassment, expands emotional and s exual education in schools and strengthens protection and compensation for victims of s exual violence.

Marisa Soleto, head of Fundacion Mujeres said it was the culmination of a 'long-awaited' demand of the feminist movement.

'We're hoping it will bring about a change in behaviour' both within Spain and beyond, she told AFP.

Spain is considered a pioneer in the fight against violence against women after in 2004 approving Europe's first law that specifically cracked down on domestic violence.

While the example seems to show a JUDGE problem..... not a law problem ........
the reality is every change in laws often has a unintended consequences ........... countries are different so not sure how it would work in many

Is Spain going to have legal contracts you can purchase like condoms........... MAYBE some enterprising person will develop an APP....
maybe everyone should be a notary too .......so they can witness signing of contracts ........
where and how do you store your PROOF that someone said yes? .........How long must you keep these records ?

unable to sign a legal binding contract while drinking or any impairment .....so no drinking on a date no meeting anyone in a bar?

many legal contracts here you have........ for example 3 days to change your mind......how would that work......

well if someone has no proof of consent they will be presumed to have used force ..Spain is not the USA.. a contract is binding.. there's no 3 days to change minds..

I still think this is an unrealistic goal....... why would anyone try to find a partner in Spain .....
and open to many wrongful accusations in the future ......... mad or know a proof was not clear say it was NOT consensual..... IMO ......

I am not annoyed and In many many situation NOT ALL ..... some folks do not assess their own risks and adding laws will not protect those

I just do not think over reach helps anyone ..........and I personally know a couple of women who claimed false things .... and think both sides should be discussed.

I think r*pe is an awful crime, and we should take all reasonable measures to stop it.

However most folks of our age understand that there can be some difficulty in sorting out the consent thing. Its related to our human nature not to always verbalize feelings in the heat of that moment... Not sure how much this will help.

I agree. The judged erred. Being incapacitated does not mean consent. Yet, I don't know how you can give consent to an act that will occur in the future, considering you can withdraw the consent at any time. How does a gentleman prove consent?
 
I have never never ever had a problem with consent nor needing to prove it. It's just never been anything I had to deal with. That didn't even enter my mind.
