Who defines bullying? The law defines bullying. Certain acts of bullying fall outside of criminal conduct. Certain acts of bullying are criminal conduct. Often a violation of harassment laws.

I would assume that the laws in the UK are quite different than those in America. I have no idea what the UK laws are regarding harassment, privacy, rights to unimpeded conduct, etc. etc. etc.

I would assume they are not dramatically different than the US, but there probably are some differences.

For example, if you walk by someone's house and yell out, "You are horribly ugly!"

That, itself, is not a criminal violation. However, if you walk by someone's house and yell that out every day, that is absolutely a violation of harassment laws.

Our Constitution guarantees people the right of freedom of assembly. And within that, we have the right to go about our normal business, without that business being obstructed by the acts of other people.

I guess the anonymity of the internet has distorted people's perceptions of what the law is, regarding interpersonal conduct.

Folks see endless hacking and trolling and do not see many arrests. And from that, get the false impression that it is all ok.

It is not all ok.

And far more people do get arrested and sued, than the media ever reports.

And then, of course, as with any crime...engaging to harm someone is always engaging in a risk.

If you hack a wheelchair bound 15 year old...you might get away with a good deal.

If that wheelchair bound 15 year old's uncle is an active member of the Mafia...yeah, you could be in a bit of trouble.

Or a lawyer, or a police officer, or just someone who is rich and has the power to bring people to bear...

Or, when did it become wise to go around poking people, when you never know if you are poking a teddy bear or a grizzly?


As a kid, John Gotti's son was riding a bicycle and was struck by a car. The driver wasn't malicious, it was just an accident. But it was serious and his son was in the hospital with serious medical problems.

That driver disappeared. The rumor on the street was that John Gotti had him tied up and murdered him (personally), torturing him to death, with a chain saw.

Good response above as to what "bullying" amounts to according to US statutes, (can't say how close UK law follows yours or vice versa).

I've always thought bullying in schools, (the only kind of bullying I'm really aware of), is sometimes simply a matter of kids choosing someone perceived as "weaker", or "different in some odd way".
This leads to a group of other kids ganging up on them, sometimes unmercilously, sometimes only until the individual boy or girl shows they've got the strength to stand up to the bullying, (I almost think there may be some evolutionary reasons why this kind of behaviour occurs).
