Domestic abusers need much higher sentences

I have been the victim of domestic abuse, and the police never take it seriously enough. I won't go into my situations here right now.. but today in the news from America.. a Man pushed his Partner onto the Subway tracks at a Manhattan station yesterday after an argument.. and a train ran over her and chopped off her feet...:mad:

Doubtless he will be sentenced in court,..when they eventually track him down... but probably for not long enough

My dad broke his hand in 3 places hitting me.
My tailbone never healed properly. Thats domestic violence also.
same here..my father broke my back...kicking me... he committed domestic violence on either my mother and more often on my brother and me at least 5 days out of every 7... I can hardly remember a day when I wasn't beaten

Unfortunately you and I had similar upbringing . Nobody should have to put up with that type of abuse. I had a fractured wrist and ribs as well. It happened so often that it became the norm. My school called the police and they got involved. They helped me move out.
Even my counsellor said I should have had him charged

I’m sincerely sorry for the abuse you have had to endure. It never really leaves you. It’s seriously haunting.

Criminal sexual contact and the assault of a police officer didn't keep him locked up long enough to prevent this attempted murder. Prosecutors need to stop making deals with criminals and judges need to start rejecting deals, especially for repeat offenders and ones with a disturbing criminal history.

Other criminals the system goes way too easy on are rapists and pedophiles. Bury them under the prisons.
 
I agree- and childhood abuse can bring a person years of internal anguish and sorrow- and even if the abuser moves far away or dies, it still has a strong affect on who we are. I hope all types of these abusers and perverts who molest children get caught and have a stiff penalty.

I am trying to forgive my father, dead for over 3 decades ,but that is hard to do.

"A Ketchum dentist pleaded guilty to felony domestic battery and misdemeanor destruction of a telecommunication device in 5th District Court on Thursday, Feb. 15, calling off a four-day jury trial that was set to begin in Hailey next Tuesday, Feb. 20.

Brian Cameron Galbraith, 49, was accused of severely beating and attempting to strangle his former wife in front of their children on Feb. 4, 2023. He originally faced up to 35 years in state prison for felony attempted strangulation, felony domestic battery in the presence of children, and misdemeanor destruction of a telecommunication device.

According to court documents filed Thursday, Feb. 15, Galbraith agreed to plead guilty to the felony domestic battery charge and misdemeanor telecommunication destruction charge in exchange for dismissal of his attempted strangulation charge.


The change-of-plea hearing, scheduled on Feb. 15, was set to take place after press time Thursday. Court minutes state that prosecutor Matt Fredback is recommending three years in state prison followed by 11 years probation.

Galbraith is now scheduled for sentencing before 5th District Judge Ned Williamson at 10 a.m. on Monday, June 10, court records show. He faces a sentence of up to 20 years in state prison if convicted on felony domestic battery. Normally, such a charge carries a maximum of 10 years in prison, but Idaho doubles the penalty if children are involved.

According to a police report filed in support of Galbraith’s arrest on Feb. 4, 2023, he broke his then-wife’s arm, jaw and teeth in an assault at their Hailey home that day. The couple’s minor children reported seeing Galbraith grab the victim by the neck, slam her onto a concrete floor in the garage, choke her, strike her and stomp on her face, and unsuccessfully ā€œtried to call 911 from their iPad tablets,ā€ police said. The children also told police that Galbraith prevented their mother from calling 911, leading to his misdemeanor charge.

Galbraith pleaded not guilty to the original pair of felony charges on May 1, 2023, setting in motion a jury trial that was ultimately rescheduled twice.

Galbraith is expected to make several more court appearances this year in connection with another case involving his former wife. He is facing new allegations of permanent disfigurement, trauma and animal abuse in a personal-injury civil lawsuit filed in 5th District Court, as well as a misdemeanor charge of violating a no-contact order protecting his ex-wife and their children.

His ex-wife’s civil complaint cited nearly a dozen instances of battery allegedly perpetrated against her by Galbraith between 2010 and 2023, including an incident documented by police in 2013 that resulted in her hospitalization and Galbraith’s arrest. The complaint also stated that the woman suffered an ulnar shaft fracture, a shattered jaw, three broken teeth, a concussion and severed facial nerves as a result of the Feb. 4 attack and required ā€œemergencyā€ surgery at Saint Alphonsus Regional Medical Center in Boise.

According to a March 2023 police report, Galbraith allegedly violated the protection order by harassing his ex-wife from his vehicle as she drove south down state Highway 75. As part of the plea deal, a related misdemeanor charge will be dropped, court records stated.

Galbraith is a registered dentist with a general dentistry license expiring in October 2024 and no history of disciplinary action in his 18 years of practice, according to the Idaho Board of Dentistry. He sold his Ketchum practice following his criminal charges in 2023."



I can't believe all that boils down to only 3 years in prison.
 
No doubt an attempted murder charge is legally proper.
I agree. He could be charged with attempted murder, but seeing how this is NYC, it is likely that due to their high backload of court cases, the prosecutor and defense attorney could cut a deal to stay out of court.

OTOH, the prosecutor may pursue the case if he gets enough heat from the public. The public seems to have a lot of pull since the big cities crime rates have risen.

In most domestic issues, the cops have their hands tied. If the abuser is a working man with a family he is supporting, it’s likely he will be bailed out and gone in less than 6 hours, depending on the severity of the abuse. It also depends on how many other times he was arrested for the same incident.

I had a case in Wilkes-Barre, Pennsylvania, where a lady was punched in the eye by her husband during an argument while they were in the garage. She picked up a screwdriver and stabbed him once on the right side of his torso and collapsed his lung. She immediately called 911 and the EMT’s arrived in less than 10 minutes. She was charged with aggravated assault, which is a felony and he was charged with simple assault, which is a misdemeanor in PA. I was supposed to go to court to testify, but both of them took plea deals.

According to latest statistics that I saw, domestic violence in PA is not very good and was on the rise over the previous year. During the COVID shutdown, DV went way up.
 
I've mentioned before that my hubby works for an organization that provides shelter for victims of domestic abuse. Two shelters are for women and one is for men (mostly gay). They even provide accommodations for children and pets.

It is so much easier to become a victim of domestic abuse than people think. I was in a gay relationship many years ago. He started out being kind and affectionate, then became jealous and argumentative. He isolated me from my friends and family. Then the pushing and hitting started. I fought back, but we were living in a condo rented in my name and I was afraid of damaging something. I went to work one day with a black eye. The relationship ended because I'd had enough. I stayed for a while because he would always apologize and cry afterward, which frequently happens in these situations.

In the case of women abused by husbands/boyfriends, the same thing happens but then there are often children involved, or the husband holds the purse strings so they have no money to leave. Many women are afraid to leave because their husbands have threatened to kill them or the children. Domestic abusers are seriously troubled individuals and should receive the maximum jail time.

One day, she was whacking me with the broom, I just grabbed it away from her and broke it over my knee. I wasn't going to take being beaten any more, but I was also big enough to enforce it. I doubt she would have stopped if she were the bigger one.

My mother did the same with the broom on me. Once aged 13 or 14..I came home after an athletic event at school proud of myself, and told her I'd jumped 13 feet in the long jump... she didn't believe me,..called me a liar and set about me in the hall with the broom handle... I thought she was going to kill me...
