Brand New DVD That Does Not Work

I've on the fence on what to do. But here is the background: I ordered a DVD (The Gorge), from a cheaper seller on ebay. It was chancy as the seller did not accept returns, and it was from Malaysia. I've been burned a few times with unplayable disks by sellers located in the Far East, and did nothing (Buyer Beware). Some of these disks seem like knock offs that come in a DVD box with cover art that seems like a digital reproduction, but missing some usual information. I've wondered if these are copies from an original made on someone's home computer, but I have nothing more than a suspicion about that.

Anyway, the disk froze at about 10 minutes. I restarted the computer and jumped ahead a few times only to have the computer freeze at new places. I tried it on two computers. So when ebay asked me for feedback, instead of ignoring it, I gave them feedback and added that I would no longer buy disks from that or similar sources. I sent for another disk from some outfit here in the states that came with a more legitimate looking cover and played well.

Next, I get a complaint from the seller that I did not contact him first before leaving a negative feedback. They want me to contact them and change the feedback. But offered no solution, and for the money it cost, I don't want the bother. ebay gives me an option to ignore the seller's request, although it seems I already have that option, and my first inclination is to leave the feedback as it is, and be done with it.

But the seller doesn't want me to be done with it and sent me a personal email requesting me to change my response, although he offered no solution to my issue. Maybe he has one, but my first inclination is to ignore him and be done with it.

I'm comfortable eating the $10 I wasted, and not sure if I should engage further. From past experience, I knew I was taking a chance, and I accept that responsibility. Anyone have suggestions?
 

I haven't used Ebay in many years. My question is, if you choose to ignore this seller are there any repercussions on you? If there are, I'd contact whoever on Ebay about the harassment from this seller.
I've considered that too. But in fact, I don't know if leaving things as they are will cause me a problem or not. There is no cautionary indications that I need to deal with this, but that doesn't mean there can be no consequences.

Maybe send him a letter from a lawyer threatening legal action for harassment. Sounds like the seller is already a bit on the shady side and you hurt his feelings while he is having a hard time building a good reputation. Plus, you are within your rights to change the feedback and add in the harassment just to ruin his day 🤣

I doubt that his intention is to harass me. I think he just doesn't want negative feedback in his "Seller's Rating." I really don't want to add more to his problem. Even the best of ebay sellers seldom make it to a 100% rating, so one bad review shouldn't break him. I don't feel harassed. But I'm annoyed that he wants me to take responsibility for him selling me a dud. He should find a better supplier. Quality control seems to be almost perfect among manufacturers of DVDs. Duds are few and far between, even used DVDs seem to be tested by most sellers and work fine, although there is risk there too.

He already has your email address, so I see no risk in emailing him back.

Say that you will replace the negative review with a positive review upon receipt of a full refund, and if that isn't acceptable, there will be no further response.

You're a nice and compassionate person. His actions definitely are harassment and he would learn the hard way dealing with me.

I'm still considering leaving this as it is. I'm tired of dealing with these kinds of second rate suppliers, although I admit they are not the norm. I'm not vital to his survival as a secondary seller on ebay.
 
On a brighter note, I once bought a used Hudson's Bay wool blanket from an ebay seller. It was a very good price, and I expected some wear, but when I got it, it was indistinguishable from a brand new Hudson's Bay blanket. That one got a very good review. Most of the time anymore, I don't review purchases. I don't think it's necessary. Nice, but not necessary.
 
I had trouble a couple of years ago with a seller concerning a vintage magazine that never arrived. She claimed she "wasn't going to take the hit" and it wasn't her responsibility for lost mail. I bypassed her because she was already bullheaded and I filed an eBay complaint. They told her it certainly *was* her responsibility as the seller and promptly refunded me.
 
File a dispute with eBay on this transaction, demand a refund.
I know that I can do this, and I did receive a refund from ebay once on a different item, although I don't know that the seller had anything to do with it. Actually, I don't need a refund to satisfy myself. I've learned a lesson from this. I knew it was a risky purchase. I'll be less cheap and more discerning in the future.
 
Here's a question for you @JustDave, if this seller is shady are you going to allow them to get away with stiffing others who purchase from him/her? Maybe think about putting your foot down, reporting them so that they are officially on notice that this is unacceptable.
 
I think I will leave things as they are. A refund is not a victory on my part, but the review will remain as is. The seller can figure out how he plans to move forward in the future. If not giving a refund is a victory to him, I really don't care. I wasn't interested in that in the first place.
