Proposed legislation in New York would include an automatic test of a driver's cell phone after an accident for texting. A textalyzer of sorts. Legislation would make it mandatory and refusing to submit your phone for a test would suspend driving privileges. Same Israeli firm Cellebrite that cracked the terrorist I phone is leading technological advancements with a textalyzer.

As much as I am against texting and driving I'm also against this involuntary testing of a private phone. And just like a breathalyzer I'm sure there would technical issues and/or misused or incorrect data. Not all for this yet.
 

I think it's something that needs to be addressed. I've often told my son the safest place for his phone when he drives is the trunk. I don't think enough young people understand that.

There are a lot of people who are old enough to know better with the same problem.
 

Very true, I mean we have traffic snarls that can last an hour or more. I do have reading material. When the car is not in motion and my foot is firmly on the brake. Unless it's going to be awhile then park, or even turn off the car for a bit. But attempting to read while driving? Nonono...I think texting while driving should be in the same violation neighborhood as drunk driving. Drunk should be a more severe offense, but texting is up there.
 
Cell phone usage, while driving, is quickly becoming the number one reason for auto accidents. Anything that can reduce this "distraction" is OK, with me. I can't count the number of times in recent years, that I have had to dodge some idiot playing with their cell phone. If I'm ever clipped by one of these fools, and survive, my lawyer and I will sue the fool for every penny they are worth.
 
Just like the dui check points. I understand the motivations behind them but that doesn't make it right or just for to give up rights to catch bad guys. This 'tool' won't just be used after an accident either. Go through a check point now they'll check for intoxication AND texting with no accident or near miss involved. Of just a speeding ticket the cop might 'ask' to see your phone. Slippery slope here. Doesn't mean they shouldn't do things to catch texting drivers but wanting the public at large to give up rights to catch a few isn't THE answer.

And if someone is caught texting while driving they are probably already at fault as is. If they caused the accident their insurance company will find out, possible tickets & points will be issued and if severe enough an arrest is still possible. This
 
I have mixed feelings, I really don't like the idea of any of these tests. Years back when cellphones were just becoming popular, I remember them saying they may ticket drivers for using them. At the time I said that they need to stop making new laws for every little thing and should keep their nose out of cell phone user's business. At the time I didn't own a cell phone, didn't get one of those until many years later, and just got a prepaid flip phone for emergency use.

Even before texting was popular, I saw enough fools on the roads and highways yacking on their cell phones and ignoring everything around them. We once were almost run off the highway at 70mph by this woman who swerved into our lane, completely oblivious to the other cars on the highway and had no clue that there was even a near serious accident caused by her. Luckily my husband is a good driver and was able to gain control before we rolled over onto the median, or worse, onto the other side of the highway in oncoming traffic.

As time goes on and I see these careless people texting now, it really angers me. They'll park 1 1/2 car lengths from a red light and have their head down both hands busy tapping those keys. Light changes, they're not going to budge until they add their smiley face and click send. :mad: Weaving over the lines is commonplace anymore, and funny the cops never see these jokers and pull them over.

I never sent a text in my life, and I don't talk on the cell phone while driving. The only one who would call me on the cell is my husband, if he needs to ask or tell me something while I'm out and about. Then he knows if I can pull over somewhere I'll talk for a minute, but many times I'll just call him back asap, when I'm parked or out of the car.

Soooo, I'm to the point where I want to see this madness stop. It's too dangerous because people are obviously too foolish to handle such a convenience. Oprah had a show once on texting drivers (teens) who killed people. This girl was touting that she could drive with her knees while texting and drove better doing it at high speeds. They video taped her and it was troubling for sure.

What happened to the time when people took responsibility for their own actions and had some common sense? Technology is turning some people's brains to mush I think.

I don't drive when I'm drinking and never had a DUI, but I'm also against those check points WhatInThe. I know about the slippery slope thing and agree that happens a lot, also don't want to give up any more rights or want a nanny government making new laws for every aspect of life.

As far as the texting and checking the phone after an accident, they already do that now by court order I believe, not good enough?
 
I understand it's one of the first things the police do over here.

Is using a cell while driving an offence in the US? It is over here.

Did you see the latest report that a multi-fatality train crash in Germany was caused because a signal operator was playing a computer game while controlling trains?
 
I have said for some time that it's a shame that they don't make the cell phone where they won't work if the car is running or moving. This would save a lot of lives or it seems it would help.
 
How could they tell you hadn't pulled over to write that text? You could argue that unless they had you in sight during the time the text in question was sent, in which case they would have pulled you over for texting. Just saying it's an argument that they could lose.

I was reading an article about computerized cars, and that they're working on an ap that will allow you to disable the texting and gaming features on specific phones inside the vehicle.

There's already an ap that basically makes the car your phone....the car can receive and make calls, and is voice activated. Instead of infringing on people's right to privacy, 'they' should legislate the availability and affordability of this kind of stuff.
 
I believe that ANYthing that will stop texting in cars is a good thing. I would be FOR this new law..... It seem people think "I will just glance quickly to this text" and then ....Ka-boom! .... it happen. No matter what - NO TEXT and if this will stop it, so be it. What they have to hide if they not texting during when the accident have occur? WHEN people are caught texting and it is the cause of the accident with PROOF that they texting at that time - it is good that they furnish the proof. I not like text and driving. (ALWAYS there is some one to tell what happen for the accident....ALWAYS some one see some thing)
 
I would almost put it up there with open container violations. Just today they had an accident that closed the turnpike. Hours of traffic backed up and medevac helicopters landing in the road. People drive bad enough around here. Add phone conversation even from a dashboard device or texting and it's just another accident waiting to happen.
