10-second groping rule

The case involves a 17-year-old student at a Rome high school.

She described walking up a staircase to class with a friend, when she felt her trousers fall down, a hand touching her buttocks and grabbing her underwear.

"Love, you know I was joking," the man told her when she turned around.

After the incident, which happened in April 2022, the student reported the caretaker, 66-year-old Antonio Avola, to police.

He admitted to groping the student without consent, but said it was a joke.

A Rome public prosecutor asked for a three-and-a-half year prison sentence but this week the caretaker was acquitted of sexual assault charges. According to the judges, what happened "does not constitute a crime" because it lasted less than 10 seconds.

Whoa! Wonder if that judge's "not a crime if not 10 seconds" stupid rule would change if someone was beating him with a hammer for ten seconds? The braindeadness (new word? 🤷‍♀️ ) of people sometimes never ceases to amaze (and anger) me.
 
Not familiar with British law, but my guess it concerned the doctrine of "Withdrawal" similar to "Reunciation".

He groped her, but withdrew his intent to commit a sex crime. Since it was almost immediate, the court determined it did not meet the criminal element defense??

Just a reasoning, but sure would like to read the opinion!

I'd hope it would be illegal to intentionally grope a person, no matter the length of time... Especially a 66 year old janitor groping a high school girl where he worked...

That is my curiousity also, the legal reasoning? Could be if the victim did not object within 10 sec., it could not be considered an unwelcome advance? Then again, now to think of it, it is probably a fake story!
 
How do the women in this forum feel about wolf whistles? In my youth, when we saw a pretty lady, we whistled and she would (most of the time) turn her head and smile at us. It was considered to be a compliment! My daughter is appalled when I tell her that it was a bit of harmless flirting! She finds wolf whistling offensive and believes that the ladies always resented it but didn't dare show their distaste! How do you feel about the subject?

I think a three and a half year sentence would have been too severe for the offense, but he should have been fired!

I know for a fact my sister took it as a compliment.

Howling at her and yelling naughty things, not so much.

In Greece, when I was a young woman and walked by a group of young men, it was normal to hear whistles. My friends/relatives would ignore them but I always found it sort of cute. One had to be careful though, because if you turned and smiled, it would encourage them to follow us, and I learned the hard way. My relatives told me to just keep walking and ignore them, lol.

This reminds me of the time I was on public transportation while in Rome and felt someone touch my behind. I heard they did it often in Rome, and I guess I was branded, too. But to pull down her pants, WOW! Either they were loose on her, and she didn't notice it (wouldn't you notice if someone pulled down YOUR pants?). but why didn't she pull them up? Why even get as far as that? Scratching my head on that one.

How many times have I heard about some brain dead redneck in this country doing or saying something to a girl/woman and then claim that it was just a joke. Probably doing it for laughs from his buddies, and not having the brains to think that the poor woman is totally humiliated or embarrassed.
