So you should remain silent. If the FBI asks you if you committed a certain bank robbery and you answer, NO, when you really committed it, that in itself is a crime.
So many just ignore being told they have the right to remain silent and just keep yakking away right into a jail cell. If I didn't do it, I can't come up with anything to say about it.So you should remain silent.
There are several foolish laws still on the books. The early Colonists must have led a very exciting life.If the FBI asks you if you committed a certain bank robbery and you answer, NO, when you really committed it, that in itself is a crime.
Biggest mistake guilty people make is to talk without legal representation. (Thankfully)So you should remain silent.
Wouldn't that be a far lesser crime? If the FBI asks you if you committed a certain bank robbery and you answer, NO, when you really committed it, that in itself is a crime.

I find these questions interesting.
The biggest mistake the innocent make is to talk without legal representation. No one should talk without representation and no one should represent himself. The huge problem, of course, is that representation costs a bundle.Biggest mistake guilty people make is to talk without legal representation. (Thankfully)
If you are versed in the law, there's little worry about talking to the cops. Public defenders do a fair job, but people like OJ have/had the bucks to have a top notch defense team. If the state/city does not intend to seek jail time if convicted, they don't have to provide Counsel, at least under the federal constitution. The problem is many do not know what to say, so some do clam up, some don't, and yes, further incriminate themselves. The biggest mistake the innocent make is to talk without legal representation. Yes. Have you ever seen some of those so called "Sovereign citizen" videos on youtube where these people claim you don't need a driver's license to drive and cite so much non-applicable law/case law, it is really amazing at the ignorance. You need to be WELL versed in the law!

One idiot cited the definition of "Carriage" from an 1843 edition of a law dictionary to support his theory, talk about weird.
Well, I would love to endorse that, but one thing I know for sure about cops is: When they(the smart cops) are in trouble they keep their mouth shut, request union rep or attorney. Police officers are (by nature and by training) geared up to find a suspect. A police officer trusts his instincts and training more than he trusts you....as a stranger. If you are versed in the law, there's little worry about talking to the cops. The Sheriff's Dept. I used to work for would encounter the Sovereign citizen types here locally. They're bit was to flaunt their unconcealed firearms carry, just tie-up the deputy's time.Yes. In most states today, it can also mean only that you are either a person of interest or a possible state's witness.Police to suspect: You are coming with us, you are going in for investigative detention/questioning.
Suspect: Am I under arrest?
Police: No, but you're coming with us anyway.
Suspect: I protest going in, but I will not resist if you force me.
Q: Is that an arrest regardless if the words "You are under arrest" are not spoken.
A: Yes.
