Drunk Driver Who Killed Cyclist Drives Drunk Again

Sentencing by judges in the U.S. are very inconsistent due to many reasons. When a judge sentence a defendant many items are taken into consideration. Different states have different penalties. The DOJ has set up guidelines for judges to use during sentencing, but the judges still have a lot of latitude when sentencing.

I have often complained about the different sentences handed down for the same crimes. It boggles the mind and if you question the judge, he gets really pissed at you (or me in this case). Money always helps. If the defendant can hire the very best legal representation, judges take that into consideration. They shouldn’t, but they do.

Mandatory sentencing has often been discussed, but too many big shot lawyers oppose it, so we are stuck with what we got. At least for now we are.
 

Those 'programs' many must go through when they get their dwis are not helping.

I've heard those 'programs' are a joke where everybody talks about how they were screwed, only had a few drinks, they rarely drink etc. Also these 'programs' are not rehab just 'education' and revenue for someone.

I know lifetime drunks that soberred up enough to take steroids, workout, get some sun etc and convinced a program supervisor on appeal they did not need to be referred to rehab with the rationale they looked healthy and there for did not have a problem. Have to wonder who staffs these programs or are they simply too busy.

Maybe it's time to start treating drunk drivers like they do have a problem which most probably do. These programs should have a more rehab oriented theme or goal.
