Eviction on my horizon.... or maybe a little corporate coercion

I have been living in a Texas independent senior apartment complex since April 2016 and have signed three leases with the management. All three were "revised" by management after signing them and the monthly rate increased.

I was told it was because my apartment was part of the low income housing credit program my apartment was subject to maximum allowable rent limits governed by HUD. Now this posting isn't about that because I have learned that no matter what amount I agree to in the lease I can be sure it will increase within a month.

No what has got my dander up is I was TOLD I can no longer pay the rent by check, I must join the apartments online community and set up an (( automatic monthly payment )). Now I even thought of complying partially with this by paying my rent with my debit card but found out if ((I do it on a month by month basis I had to pay extra ))!


So if there are any real-estate lawyers out there

and tell me if I must comply thanks.

The complex where I live in New York is moving in a similar direction with a company called RentTrack.

This isn't a legal forum.
You should contact your local bar association and get name & number if an attorney who practices real estate law - no charge for initial consultation.
And remove your email address.
 
Don't get evicted and lose your apartment! Can you talk to your bank? I understand they can do some kind of auto set up. I don't blame you for not liking this. I don't do direct deposit with my paycheck. And what is someone to do who has no computer? Maybe the bank option. I don't know.

I hate to say it, but comply. Don't lose your home! They kind of sound like jerks though.
 
I don't understand why this is a problem, either. Just set it up through your bank. Don't screw up and get evicted from your apartment -- the waiting list is probably horrific and eviction might disqualify you from another placement. You'd probably find the same thing to be true with another landlord anyway.

This is probably one of those "don't cut off your nose to spite your face" things, anyway. Just set it up and move on.

Can you arrange for them to automatically debit the rent from your checking account every month ??

That is how I pay my monthly utility bill. Just make sure you have enough to cover it.

I would be happy to have them take it out of my bank account and will be happy to do so when I have to. You are blessed to have HUD which is not available in most places. I don't see where you have anything to gripe about especially since you have HUD.
 
I don't know if it is the same in America with
bank cards as it is here.

If I have a direct debit agreement with any
company, they ask for the amount each month,
there is no set figure and they can change it
when they like.

If I set up a voluntary monthly payment called
a "Standing Order", I set the date and the amount
to be paid every month, or week, or six months
and the recipients cannot alter the amount or any
other part of my instructions to my bank.

Bad heart... I was no longer able to physically do what was needed to live in the woods.
Plus my son made it appear that this was the right place for me.
