Jesus Christ! They're coming out of the woodwork like the cockroaches that they are. Hopefully he won't come back and shoot up the place now that he's out on bail.

A Florida man was arrested and charged with simple battery after writing an anti-gay remark on a restaurant bill, then forcing the receipt down a female manager’s shirt.

On July 27th, Frederic Sterry Smith, 62, and a female companion were finishing their meals at Milagro On 12 Latin Kitchen in St. Augustine, where the incident occurred.

When presented with the bill, Smith allegedly did not leave a tip and instead wrote, "If he wasn't gay." The waiter showed his manager the receipt, and she walked outside of the restaurant to confront Smith, Naples Daily News reports.

Smith admitted to writing the note, grabbed the receipt from her hand, ripped it up, and pulled open her collar to shove the check down her shirt. He also reportedly touched her breast while doing so.

According to the Naples Daily News, a coworker said that Smith told the manager that he would "[expletive] rip it up in her face" before forcing the check down her blouse.

Police were able to locate Smith within an hour. Smith denied the incident and became verbally abusive to the responding officers.

"I can say whatever I want, to whoever I want!" Smith said, according to the Naples Daily News.

That day, Smith was arrested and charged with simple battery, a misdemeanor, and his bail was set at $500. According to St. Johns County Sheriff's Office jail records, Smith was released the following day.

Why, toffee? People are getting arrested for the slightest thing these days. Not a mental problem, just a problem with manners.

No decent person would do it. Even if someone disliked gay people, they should still treat them with respect. There are too many ill-mannered brutes around who think they are being clever by humiliating someone, whether gay or coloured.
 
I don't think manners have much to do with this. It sounds like the guy physically assaulted the manager. Since when do we have the right to shove something down someone's shirt? This guy needs anger management classes after he gets out of jail.

Is he going to be jailed? It would make more sense for him to compensate the victim. Put him in the kitchen and make him wash-up by hand for a week. Take the gay man out for a meal.
 
I don't believe Smith used "hate" speech in what he wrote on the check. And he is quite in his right to not leave a gratuity. But in touching the manager, he was guilty of simple assault. I question the manager's decision to leave the restaurant and challenging him outside. There's really not much that would have been accomplished by doing that. Although, it might have been great to give him a piece of her mind.
 
While he had no right to put his hands on her, the waitress was incredibly stupid to confront him. Confronting an idiot makes you a bigger idiot because it escalates the conflict. (That goes for drivers, too)
When I was married, my wife & I went to a restaurant that we frequented & were treated very nicely & we always tipped generously. On one visit, a new waitress was extremely rude to us; whenever we asked for anything, she replied, "You have enough," & ignored us most of the time. I left her a dime tip. As we were driving out of the parking lot, she stormed out of the restaurant, screaming at us & threw the dime at our car. (It hit our car, but no damage)
I spoke to the owner, her fired her on the spot & gave us $100.00 in complimentary visits. The waitress probably learned a lot that day.
