Parking violations

chalking of tires as an enforcement of a parking violation has been found to violate the 4th amendment.

I don't know which case you are referencing, but the Sixth Circuit Court of Appeals, which includes Ohio, ruled on such a case a few years back, closely argued decision.
 

We don't have that in the UK... ..I wouldn't be happy if someone chalked my tyres.. how irritating !

What's the reasoning behind that?.. is this a warning instead of giving a ticket..or is it along with a ticket... ?
 
When the tire has been chalked, the bylaw person can return there in an hour, if it’s an hour long parking zone, and know the car has been there over the permitted time. Usually it’s been much longer.
 
How much did she spend on an attorney to fight this unjustness? Probably more than the $15 ticket. And, she had how many parking citations? She is definitely a serial parking meter violator. The world just keeps getting nuttier and nuttier.

The chalking does not include a fine, until the parking officer returns and the car is still parked past its allowed time.

IMO, the court is far-reaching on the definition of what a search is. How chalking can be a search is beyond me.

A Search occurs when a persons privacy is invaded. A "pat down" by police checking for weapons IS a search, even though reaching inside pockets is not done. The term Search means more than looking inside say a woman's purse for contraband. The case explains the reasoning.

A ticket can only be issued when the offense has occurred but is also discretionary to issue. Many jurisdictions have reduced parking violations to what are known as "Infractions", a NON criminal offense, just a civil violation.
 
We have 3 hr. parking in our town. Interesting is, a person can go move their car after 2.8 hrs to a different place even just up one spot & the time starts over. The police cars have cameras that take a picture of cars in parking spots. So if one comes back & that car is in the same spot on their laptop screen, they get out & put a "boot" on one of the front wheels.

Now that person can not move that car until he goes to the police station & pays a fine of $75.00 They come by & unlock the device & put it in their trunk again. Very few local people get booted.
 
I know it seems like a trivial thing- a chalk line. But what right does a cop have to mark my car? I guess it's perfectly legal for me to go over, and chalk the cruiser's tires., and they won't say a word. Plus I really don't want anyone messing around with my tires. If you keep erasing the chalk line, you can park all day long. What happens if you park, and the chalk line from two days ago is still visible-do you get a ticket.? Come into the 21st century, get a camera, and keep your paws off my tires.
 
I'm sure they record other evidentiary elements, tag #, make/model, VIN, etc. also.
Around here, it’s just the mark. They don’t waste time writing down things unless they’re giving a ticket.

They used to make an announcement on the P.A. system at work. People would flow out and move their cars. A ticket was $5, a parking spot behind the building was $20 a month.

Businesses get upset about staff hogging all the parking spaces near their stores. Same with parking meters that they just keep filling up with coins.
