What Is a Hate Crime?

Well, you start with some sort of vandalism charge for custody purposes, then, as you say, let the Prosecutor make that decision based on case law precedents. On its face, it very well could be a hate crime, at least federally. In PA, are the locals permitted to arrest on federal charges?

We don’t really have a “vandalism” charge. Normally, it’s Criminal Mischief, which is a felony.

If a crime us committed on Federal owned land, we can hold them for the Feds to make the arrest and apply the appropriate charges. If the crime is committed on private or state property, their ass belonged to us.

What is the definition of a hate crime? Are all the rapes and murders of women and girls in the U.S. hate crimes? Perpetrated by men who hate women? Are women and girls the largest victims of hate crimes in America?

There are (at least) two definitions for "hate crime". One is the legal definition, and other our common usage of the term.

In the UK, a "hate crime" is a crime that demonstrates hostility based on race, religion, disability, sexual orientation or transgender identity.

As such, I don't think rapes and murders of women are hate crimes. They're rape and murder.

Of course, in common usage one might say that a rapist hates women, etc.
