This three year old girl had been denied permission to use the toilet while a Jet Blue flight was on the ground awaiting to take off. There are regulations set by the FAA, because the plane may move suddenly and cause someone to be injured.
I think the stewardess could have checked with the pilot to see how much time they were really expected to wait before the plane moved, and the girl could have been escorted to use the toilet. Honestly, if I was traveling by plane with my 3 year old, I'd put a pair of 'pull-ups' on her for such emergencies.
It seems like people are so sue-crazy, that they just keep putting more and more rules in place to protect themselves against lawsuits. People dealing directly with the situation are afraid to make a judgment call and use common sense to handle the matter at hand.
