WOW! I'm getting the runaround big time!

Just a rant. Hope you don't mind.

As most of you know, my husband passed away suddenly in October. In March, he and I leased a new truck from a local dealership. Since my name is on the lease, I'm responsible for the payments now. I'm only going to be getting his SS and that truck payment will be difficult for me.

Since it's a new lease, the dealership doesn't want to do a buy back. I've contacted them several times to try to work this out. I need a vehicle, so why should it be so difficult for them to buy the truck back and let me buy a vehicle? I even called Nissan to ask them questions on a buy back but they said it's completely up to the dealership.

Why do they make this so difficult? Is it because I'm a widowed women that doesn't know what she's talking about (that's what they think, I'm sure) and she doesn't have anyone (male) to go with her to support her? AAARRGGGHHH! It's frustrating!

Moral of the story, ladies....don't EVER put your name on a lease with your husband! If it would have been just his name on the lease, I could have just handed it back to them. Now, I'm sure it's going to cost me additional money I don't have.
 

I'm not knowledgeable on this. I'd never lease a vehicle myself.

But is it possible there is a way to sublease the vehicle to somebody without risk to yourself? Possibly at a small discount to grease the wheels?

This must come up a lot though. Maybe a lawyer could arrange a contract safely for a modest fee?
 
I was just about to say that if you didn’t co-sign , you wouldn’t be responsible. Then read that you did. I don’t know the laws in your jurisdiction but I’m sure there’s someone who can help

I looked into that because I had 2 men that were interested in buying it but with a lease, you're not allowed to sell or trade it in at another dealership. The vehicle is technically not yours. It belongs to the leasing company, in this case Nissan.

I just searched your problem online and it doesn't look good. I don't know what the answer would be or what happens if you default and just don't pay it. I mean they can't get money out of you if you don't have it.

Will they do a Trade-In?

What's the term of the lease? I mean, does it have a renewal date? That's when they'll talk about getting you into another vehicle.
 
Colleen, I had a similar experience....I bought a van and about 4 months later, I didn't need it.

I took it back to the dealership and said "I have to relinquish this vehicle."

Dealerships have Relinquishment forms.

My van wasn't on a lease, though. I was buying it. But maybe that's worth a try.

They re-sold the van for less than the equity and billed me for the difference, but I simply never paid it. And nothing happened.

I'm curious what they will come up with tomorrow when I go for the state inspection. I have an appointment with an assistant manager. I've been trying to do a trade-in for a smaller vehicle for me and I'm willing to look at new vehicles. Don't understand why they wouldn't want to sell me a new car, do you?

The lease was for 36 months. We got it in March and it's December so it's a new lease. They don't like to take them back unless there's been 12 monthly payments. We've made 10. I'd be willing to make the last 2 if they will negotiate. Am I asking too much????

Not in my opinion.

If you get nowhere with them, let them know what a headache they've been, and that you absolutely cannot recommend them to friends and relatives anymore because of it.

One of my nephews couldn't make payments on his new car because he lost his job, and the dealer wouldn't work with him and they were really smug and condescending about it, so one day he drove the car to the lot, left the keys and all the paperwork with the receptionist, and walked away.

He ignored the bills, and when they called (every month) he simply told them he couldn't make the payments, period. The bills and calls stopped after 6 months and nothing else happened.

I honestly don't think there's a whole lot a dealership can do if your financial situation changes and you can't afford your vehicle.

If it was me, I'd take the car over there, make the last 2 payments, and leave it.

Here's the thing, Colleen; they're screwed and they know it.

There's no debtors prison, you haven't done and won't do anything anyone can charge you with, and they can't squeeze blood out of a turnip.

They also can't harass you, because that IS illegal. They can bill and call within reason, and only for a reasonable period if time. Basically, their options are as limited as yours. They know that, so they might bully you or scare you. Don't let them.

In this case social media "may" be on your side, if all other options fail tell them that you will be forced to leave a bad review online on multiple platforms since they are taking advantage of a widow. You may also want to contact a local news channel to see if they are interested on reporting how the dealership is taking advantage of a widow. I doubt that they will want the bad press as it could cost them much more in the long run.
 
I agree with that suggestion. Tell them you will think about contacting a local reporter. To let others know.

You're not asking too much, for them to work something out with you.

That is awful that they aren't offering to, without putting extra stress on you.
Even if it's their legal right to do so.

This should not be the goal of their policies or contracts. You haven't run and hid. You've told them the honest situation. They should want to offer you some option.

was gonna suggest something similar, but didn't wanna sound sleazy. most tv news channels have some sort of feature where they help people who are in situations where they're just spinning their wheels. i don't wanna sound crass, but may need to play the "poor widow" card. no business wants a disgruntled customer with an audience.

I don't mind sounding sleazy when dealing with companies whos only motivation is money. And I don't see it as playing the "poor widow" card when it is the truth.
 
You don't want to get a hit to your credit if you can help it. Did you read your contract and see if there is an early termination clause? You might be able to work something out with extended payments or a partial payment to end the lease. I would definitely go up the chain of command till you find someone who will negotiate with you. If you get nowhere, have your lawyer check your lease terms and see if you can outright sell the vehicle and then pay off the lease.
 
Thanks for the links. I read the Swap a lease one and here's part of what it says: Starting 1/1/2019 NMAC will no longer permit transfers on leases with more than one original lessee (co-lessee or co-signor).

I've talked to Nissan Finance several times and they have told me every time that I am NOT allowed to sell or sub-lease or trade at another dealership.

I feel like I'm in handcuffs and don't have any alternatives.

We leased it in March of this year and hubby died October 13th. There have been 10 payments made and I know the lease says 12 payments have to be made before an early termination can be done. I'm willing to make those 2 payments to end the lease. I'll see what they tell me when I go today to get the state inspection done.
