Unbuckled 6-year-old fell to her death on an amusement park ride. Who's responsible?

I don't know much about these amusement park rides or how they are put together. But it probably would just be good sense to require that each "car" is enclosed in such a way that it is impossible for anyone, of any age or size, to jump or fall from it, All it would take is an installation of screens or bars.
 

Manufacturer liable. A device that can kill people should not have an override button. If "Problem Exists" ride should not operate until problem fixed.
Sort of a dead man's switch or maybe a brain dead switch.
