There is a Florida lady who is suing Kraft — the manufacturers of Velveeta — because she says its microwaveable mac and cheese takes longer to make than advertised on the package.

See, the Velveeta Shells And Cheese Original microwavable mac package says that it will be ready in 3 1/2 minutes.

But, in actuality, if you follow the directions as stated, it might take closer to 4 minutes.

Kraft didn’t account for ALL the steps when they claim it takes 3 1/2 minutes to make.


There is the cooking step — which takes 3 1/2 minutes — but you also have to tear the top off the package, add water, and stir it when it comes out of the microwave.

Yes. I’m completely serious right now.

She actually went to a lawyer with this information, and is bringing a class action lawsuit against the company.

According to the complaint, the additional three steps mean that it’s impossible for the Velveeta Mac and Cheese to be ready in just 3 1/2 minutes.


Amanda Ramirez, who is bringing the lawsuit, claims that the Kraft Heinz Food Company is misleading consumers with the “false” claim.

[She] paid more for the Product than she would have [otherwise] paid, and would not have purchased it or paid less had she known the truth.

She is seeking — wait for it — $5 million with this lawsuit.
What does Kraft have to say about the whole thing?

"We are aware of this frivolous lawsuit and will strongly defend against the allegations in the complaint."

Ok, I read it despite my head. Nope, this will never see the light of day. Anyone can sue for anything till a judge tosses it out. That will happen here.

No, I sympathize with her about the extra 30 seconds. As I've mentioned here before, I get flustered by all the extra steps (and time) involved in supposedly simple tasks.

Nothing takes the purported "just a few minutes" or whatever. The difference between me and her is that I already know this and am not going to sue anybody.
 
Question... in the USA.. if someone brings a lawsuit like this one.. and they lose.. do they have to pay the court costs on top of their lawyers fees ?
Sure it can happen, however in my experience its rare. Especially awarding costs from an individual to a large corporation.

I am not a lawyer, and my experience is limited to cases where I have served as an expert witness. Others here probably know more.

well it would be very wrong of an individual to sue a corportation and cost them potentially millions defending their case, then walk away without recompensing them.. it would surely be a deterrent against nutters like these.. it certainly is here...

but the whole problem with this particular case is that.. who says it takes 30 seconds more ?.. only her ... and it's all in personal taste. Kraft may say that to have Pasta Al dente it needs 3. 30 .. and this woman might prefer her pasta well done.. and therefore another 30 seconds of cooking..

Kraft would be in the right in that instance because 3.30 seconds gets it cooked.. and tbh.. I have eaten Kraft mac & cheese in my youth.. ,..and I've never had to cook it longer than it states on the box..
