Man told to cover/fence off boat in driveway. Paints a picture of boat on fence gate

It has to be a silly council that sits in a city
called seaside and they don't like boats kept
beside a house, there must be lots of boats
beside a house at some time in the year, if
a storm is coming, or if the owners wants
to clean the bottom, they would complain
if some "out-of-the-water" maintenance
was done somewhere else, other than at
the owners house.

Interesting story!
When we moved to NW Florida what caught my attention was the great amount of boats parked behind the fence of practically all homes. It was a way of life there. House, car, tree, fence and boat! They are definitely water people over there. It did not bother me a bit and we lived in a HOA subdivision.
 

Maybe the Council were really thinking about
stopping any theft of the boat, because of the
fence, there may be no malice attached to the
requirement of the fence!

The city made him store his boat behind a 6 foot fence or screen based on a municipal code. I haven't seen any mention of an HOA.

There don't seem to be clear grounds on which the city might object to this creative fence.

Why would you imagine he'd go to all that trouble and not follow the ordinance to the exact letter of the law? Nothing in the code states he has to cover his boat.

Operative boats and large pickup campers, motor homes, recreation vehicles, utility trailers, and vacation trailers shall be allowed to be parked or stored in a required rear or side setback in a residential district only if screened on the side and front by a six-foot-high fence. In these instances, the provision of adequate light and air to a neighbor’s window shall not be obstructed."

Furthermore, the city leaders are apparently quite pleased with his act of rebellion:

"In May, Police Chief Nick Borges, who currently serves as the acting city manager, visited Constable's home to discuss the fence's mural.

During their meeting, Borges not only extended his congratulations to Constable but also expressed his admiration with a heartfelt high-five. According to Constable, Borges also mentioned that he was in favor of the city getting rid of some ordinances, including Title 17.

"We're not taking any action," local news outlet KSBW reported Borges said. "The only action I'm going to take is a high five, and that's it."'

Someone please post the regulations that show the requirements (ordnances, rules, whatever) of the authorities who told the man to obscure his boat from public view.
I am asking someone to post these because previous posters mentioned that the requirements were presented by some authority. If there was a comment about the requirements then someone on this board must have read them. I simply want to read those requirements. Fair enough? That will give all readers a chance to read them. Good nite, I am hitting the sack.

Consider the very careful way in which the artist has depicted on the painted fence what is behind the fence. The details of the bricks, the shrubs, etc. Then notice on the painted fence to the right side the very green border of shrubs, trees. Do you think the artist would have gone to all that painstaking effort to duplicate what is behind the fence only to pass over a very obvious detail which is supposedly behind the fence?

There is no side fence of any kind alongside the boat, as depicted by the painted fence. Why would this hugely obvious side fence be left out if it were really there? Because it isn't there. Now read again what the ordnance says about fencing. Then tell me the homeowner is in compliance with the ordnance.

I'm not presuming that the driveway is the border of his property and his neighbor's. Or perhaps a fence would have obstructed his neighbor's light. Whatever the case, the town considers his compliance with the law to be adequate.

At least give me credit for using a train of logic and reasonable analysis in making the point that, given all the information that was presented here (not withstanding the town's opinion) , it could be concluded that the conditions of the ordnance were not followed. That is what the presented evidence shows. Some inference is necessary, but that's ok. I say he should cover the boat or install a sideyard fence next to the boat. I am fining him $250. Case closed.

Yes and maybe the painting of the non-fenced sideyard is in keeping with the fact that no sideyard fence was there to depict on the painted fence. But, oh well, I have better things to do.
