Attempted murder of a corpse

This is a very interesting scenario. If the coroner can somehow prove that the man was still alive when the other man shot him, then I may agree. (I say 'may' because there are other extenuating circumstances that may come into play.) However, if his movements were involuntary reflexes caused by the nerves still being active, then the man probably should not be accused of murder, but maybe abuse of a corpse. This is one of those things that lawyers and prosecutors have to toss around between them.

When a person dies, so does the brain, generally speaking. However, the nerves may still send signals to the spinal cord, which in turn will cause the nerves to twitch. I don't have much knowledge regarding medicine, but I have seen people that have died and still have nerves twitching and fluttering. It's sort of like when a person chops off the head of a chicken and the chicken still wants to run around, thus the saying, "Running around like a chicken with its head cut off."
 
Around here, if the guy was already dead, you'd only be charged with abuse of a corpse. As 911 said, I think it would be a factual question of whether the victim was already dead or not. Maybe the medical examiner can tell, maybe not, depending on how long the victim had been dead (or not).
 
Take this for what it's worth, I can't confirm it.

My clan came from way up in the hills of Kentucky......picture Deliverance, moonshiners, Hatfields & McCoys etc. and without a morgue / refrigeration, embalming etc they tended to bury the person pretty quick.

My aunt told me a story many moons ago about a older gal that was having HER funeral in a little wooden one room church the day after she had died and as people were filing by viewing her she sat up in the casket, still very much alive, and lived another ten years or so......if that wouldn't make you swear off moonshine I don't know what would. :D

If true it does kinda make you wonder tho how many people were actually buried alive by mistake back in the old days.
