Fat people will be protected from discrimination under law passed in New York

like I say, Employers will probably react to Overweight people who are clearly not suitable for a job by turning them down using a different reason..

here in the Uk it's illegal to turn someone down due to age... so instead the potential employer states the reason was ..something else.. attitude, lack of qualifications/experience, etc.. ..so I suspect that's exactly what will happen when they have to trun someone away who is very overweight..
The work we did required several years of training and experience to be proficient. Hiring an older person was an issue since they may not have time to become proficient prior to retiring.

We need a war! Then nobody would be worried about anyone being fat, skinny or whatever; especially when a bomb hits the building next to your home. Sometimes, I just got so tired of listening to the so called "problems" of the First World. For example, changing the name for Christmas to Winter Festival, building a 3rd bathroom for those that are not "comfortable" with the term men/women and the dozens of abuses that apparently everyone is greatly suffering here in the First World.
I wouldn't agree to the war but otherwise you're right on!

yes I understand that when it's genuine.. but like I said..to get around the age descrimination act when employers don't want an older person.. they invent some other excuse..

Some value for employment purposes where weight would be a non-issue. However just like the large numbers of relatively unattractive and plain humans, or those with a long list of appearance issues like oddly dressed, grooming style, and voice, there is little a law will be able to do to change such culturally ingrained behaviors that are closely related to mating and reproduction once it is entrenched in culture and society. Yes we have been intensely trying to do so regarding racial issues but that was just the tip of an iceberg.

In the past lawyers have tried to sue restaurants and other public services employers for obviously only hiring attractive persons without much success. Every new law like this gives ammunition to lawyers, the real agenda of politicians since the majority of them were educated as lawyers. One cannot with legislation change human nature of those that have already lived within our culture and society regarding attractiveness. IMO there ought not be laws against attractiveness for many jobs where people interface directly with the general public and HR policies publicly state whatever.

I as a 5'6" 135# male Caucasian, have been discriminated against all my adult life. I as an unknown, may not have liked been chosen last at every new school I went to when other kids made sport team selections, but understand why, accept such as natural just like is the case with many animal species, and have done just fine regardless. We intelligent Earth monkeys are moving through an extraordinary period where within the span of single lifetimes, people from across the planet due to travel and communication technology are suddenly thrust into societal environments with others from A to Z from across the planet. That is acutely so in many large urban areas, especially here where I live in the San Francisco Bay Area.

At extremes, there are stark differences in general physical attractiveness between people born to those with long lineages of elites versus many indigenous third world people where those able to eke out a living and survive has had more to do with non-appearance issues. As a result, one finds many of the most physically attractive people from urban cultures where appearance over centuries has always been a key selective process of those with power and wealth. For Caucasian men the result is relatively large size and physical strength in order for within a king's army to better hand to hand war battle while with women it has been about perceived beauty. In centuries past, young nobles scoured countrysides for the most attractive young women to be brought into castle life. It is utterly amazing how quickly over generations that has wrought what we find.

That crap can kiss my fat ass! No one should ever be harassed, put down, humiliated regarding their weight. But this acceptance stuff gets on my nerves.

And it's true, they can always say that young, thin, attractive person was the most qualified for the job description.

I understand the perspective in your last sentence, and I don't disagree. However, I have to say that when it came to hiring people I really looked for the person that was most qualified to do the job, had a good personality for dealing with customers, and was a team player, not a loner. We did field service on complex machinery and it was imperative to work as a team. I had zero use for a really attractive, unqualified, or lazy person.

UK obesity standards determine, if your BMI is below 18.5 – you're in the underweight range. 18.5 to 24.9 – you're in the healthy weight range. 25 to 29.9 – you're in the overweight range. 30 to 39.9 – you're in the obese range.

Britain is starting to overtake America in obesity rates, with the latest figures showing that more children in England are classed as obese at the age of 11 than in the US. ( Department of Health, UK)

More than half the world's population will be classed as obese or overweight by 2035 if action is not taken, the World Obesity Federation warns.

This is certainly a tragic future and something has to be done….although no one should be discriminated against for any reason…serious steps must be taken to educate people about obesity and a better way of eating and living.

Here in the U.S. we have a set of laws that cover disabilities and is referred to as the ADA laws or American With Disabilities Act. The 7th Circuit Court of Appeals has already ruled that obesity is not covered as a true disability, unless they can prove their obesity is caused by a true physiological disorder. We all know that Federal laws trump state laws.

So now my questions immediately are these

1... what will they decide is fat... if someone calls another person who is 8 stones (112 pounds)..FAT.. will they face prosecution..?

2.. will it be abused like so many other things when someone is looking to have someone else arrested... '' he called me the N word.. he called me transphobic.. she called me a man when I'm really a she.... he called me Fat

Where does it say a person can't be called 'fat' or 'short'? It sounds only like not hiring (or firing) someone for being fat or short would be illegal. I'm surprised it needs a law at all, I would have thought it would have been covered by current laws somehow.

Well, to be honest with you ..I don't need to see it.. unfortunately it's one of the things that are the least positive things about the USA that's very well known outside of America.. and that is that the population tends to be much bigger and heavier than the rest of the world..

Even tourists come back saying they cannot believe the size of the portions served to them in restaurants... usually twice if not 3 times the size which are served outside of the USA .
Yes! I'm from Canada and I too have noticed the monster plates of food that Americans eat. I'm not saying there are no fat people in Canada because there are. However, traveling through the US I am always shocked at the monster sized people. It seems to me that eating is a religion there. Maybe there is some sort of competition to see who can eat more and who can put on more "tonnage' in the stomach. I'm not using the word "poundage" because it doesn't seem to really describe the self-induced punishment that they give their bodies.

the self-induced punishment that they give their bodies

This is a great way of putting it........
i have seen many comments on the Monster portions..... simple split portion with someone OR take leftovers home...

I have never seen some person at restaurants saying ............."clean your plate ....you are not leaving until you are done !"

People need to access why they are eating constantly........ boredom / anger/ depression ........
most of it is what people drink as well some Starbucks flavored drinks with whipped creme etc can be as many as 1200 calories most of the day intake....

yes but it's not just about employment.. if someone calls you fat.. you'll be able to sue them.... or vicky verky..if someone SAYS you called them fat you will have broken the law,..even if you didn't..
I don't think the bill includes anything about calling someone "fat." It makes it illegal to discriminate against someone who is obese when it comes to employment, housing, and public accommodations, and there are exceptions for employment when the person's weight or height would prevent him or her from doing their job.

Well, you’re not going to like this but it’s just the legal side of me. The word “Discrimination” is a legal word. Therefore, it’s up to the court to decide. Maybe Ohioboy can shed more light on the subject.
Thanks for the rep. Right, in the context of a law, discrimination is a Legal term. Ordinarily, it is a personal opinion. Have not read the proposed law, but it would probably be subject to a Civil Rights Commission complaint before a suit could be filed?? IOW, requiring a "Right to sue" letter?? The problem may be, as with any protected class allegation, some may be looking for a windfall from an unfounded charge.

Bill of rights: Toothless New York citizens are no longer responsible for eating everything on their plate.

What goes around comes around. You can make it illegal to make fun of "big" people and you can make it illegal to refuse them employment and you plaster "FAT IS BEAUTIFUL" signs all over New York City.

However, the truth is that most obese folks have a shorter life span. Other factors to consider:

Adults with obesity have higher risks for stroke, many types of cancer, premature death, and mental illness such as clinical depression and anxiety.

Just over 1 in 3 young adults aged 17-24 is too heavy to serve in the US military

  • High blood pressure and high cholesterol which are risk factors for heart disease.
  • Type 2 diabetes.
  • Breathing problems, such as asthma and sleep apnea.
The law may be on your side but there is a price to pay. Best to get on a treadmill so start walking outside each and everyday. Good luck!
Joint problems such as osteoarthritis and musculoskeletal discomfortGallstones and gallbladder disease.

I don't believe in fat is beautiful or inclusivity. I don't, as I said above, want to be harassed. I outwork and do a better job then people who look a whole lot better than me. I've done it for years.

I don't doubt that my abuse and eating disorder will shorten my life. Just like I'm sure a number of drug addicts, alcoholics, incarcerated (a therapist told me people with my childhood may end up in prison among other things) will have shortened lives.

Look up ACE Scores. I wish I'd never heard of them but mine is high. If it were so easy to weigh 105 pounds, I'd been there years ago.

I needed way more than luck.

A number of studies, in recent years, are showing that Obesity is the root cause of almost 1/3rd of our nations health problems and costs.
