First time for everything I guess

I spent three and half hours in the police department yesterday. After I was taken to a cubby hole of a room with a table and 3 chairs in it and offered a drink, that’s when the “interview” began. First, I had to write on a tablet in my own words everything that happened. Once the female detective read it, she was joined by another male detective. They went over it reading it back to me sentence by sentence. After each sentence they would pause and ask a question, even if it really didn’t have any meaning. Every sentence was followed by at least one question or more. I wrote the words “the couple.” The detective asks “What do you mean “the couple.” I said “You know, a couple. A man and a woman.” More questions, “Are you sure it was a man and a woman?” On and on it went. When we were done, two more detectives came in and asked almost the same questions. By the way, everything was on video and voice recorders.

The one detective asked me if I aimed. I told him no, not really, I aimed at him, but not at any certain part of his body. He said “ ok, you did aim, but not necessarily to kill. Am I right?” I told him yeah, that sounds about right.” My son said they may ask for your gun. If they do, make sure you get a receipt with the serial number written on the receipt and don’t be surprised if you don’t get it back. Some states do not return weapons that were involved in a crime. I told my son I didn’t do anything criminal. He said, nonetheless, some states don’t return weapons.

About halfway through, I was wishing I would have stayed home, but that would have only brought them to me. As we were finishing, another detective came into the room and took one of my detectives out into the hallway. When he came back in, the detective told us that the CODIS report from the swab of blood they took off the ground came back from the lab. He told all of us in the room that the man shot has outstanding warrants in North Carolina and Tennessee, but he didn’t say for what. The man wasn’t in custody as of when I left the station. They told me that when they get this guy, I may be called to testify in court if it gets that far. I told them I never had a good look at his face. He said that wouldn’t be a problem. His DNA puts him there.

As they walked me down the hallway towards the door, the female cop said the couple involved said to tell you thanks. I thought that was nice.

I mean, if a person says they're unwilling to defend themselves/their loved ones, what hope is there?
 
Wow it's scary and hard to know the right thing to do. I was just reading on a news site recently where a man was robbing people and bystander shot and killed him as he was running away. When they went to retrieve the criminal's "gun", it was a fake or toy gun. Now the bystander who shot him is in a bad position as far as not knowing what will happen to him. Because he shot an unarmed man and because he shot him as he was running away. So it's very scary to know the right thing to do with only seconds to think about it before acting.

It makes NO difference whether the gun was a toy or not. What happens when someone points a real-looking toy gun at a police officer?

I have seen others crucify my actions that happened so yes, they are out there I totally agree with you U96 I do not do well around those like that either. I did actually meet one years back. He was big time anti most everything especially hunting and owned a buthcer shop that had a sign "We process wild game."

Such is life, we have people on here just to goad, insult and sneer. The "Ignore" button is so useful.
 
Here’s something I learned. During the investigation, the police took my gun. I still haven’t gotten it back. I have heard from others that I may not. I have 2 other pistols and I still carry.

I wish my Cheryl was here. She would have really loved today. It was 87 degrees here and I took the boat out for a ride just around in the bay. She always liked to go out into the bay and let it drift.

A lady nearby in the neighborhood has started stopping by. A few people are trying to convince me that she is a cougar and on the hunt, but I think she is just being kind. She lost her husband a few years back also to cancer. She enjoys talking about her only child, a daughter that lives in Arizona and wants her mom to move out there and live with her and her husband, but like me, she has settled in and really doesn’t want to start all over again.

For some reason, I hate the nighttime. I feel very alone. We had a murder about 2 blocks away on Sunday night. As the story goes, some guys got into an argument over a football game and the one guy shot the other killing him. He’s claiming self defense. I’m guessing alcohol was involved.

I'd be contacting an attorney. Your property isn't "Up for grabs" or can be taken without good reason.

If it was a high-quality gun, police will come up with every excuse not to return it. It's called "Legal Theft." It happens all the time.
The only reason my gun wasn't permanently confiscated was because I wasn't forced to fire it; pointing it was enough.

I spent $900 on the pistol and had a Sig Sauer red dot scope mounted on it for another $550.00. The scope didn’t cost $550, but to have it sighted and mounted wasn’t cheap. The holster was less than $70.00. I don’t even have that anymore. I don’t shoot competition, but my neighbor does and he was the person who picked out this weapon for me.

Moon: NSA = never say anything! to lawyers or the law UNLESS you have YOUR lawyer (criminal, gun law specialist preferred) present.

Your police interviewers used every trick to get info and incriminating evidence ON YOU. Writing and rereading the statements is typical.

Expect the perp or a lefty org (ACLU) to sue.

Legal tips..."I assert my 5th amendment rights"
"I want a lawyer"
Deposition, interrogation, cross exam:
Yes or no answers
Never volunteer info
"I cant recall"
About any Third party...How would I know you have to ask her/ him..

I spoke with the DA about getting my gun back and not him, but one of the Assistant DA’s told me that they are permitted by law to hold it for up to 2 years. If I want it back, I have to file a “Claim for Returned Personal Property.” I asked him if that means I can get it back sooner and he said no, but I may not get it back at all if I don’t file the claim. After I filled out the claim form, I noticed that it had written on it that I must file the claim within 1 year of the item being confiscated, along with a $75 fee. If I move, it’s my responsibility to contact the Property Division of the DA Office. If they send the item to the address on file and it is returned, they will not send it out again and the item will most likely be destroyed or sold.

Making it so difficult or impossible allows them to steal it. No other way to put it. If a gun was not used in a crime, there is no reason not to return it, except to find an excuse to steal a valuable item. I've chatted with citizens on gun forums & they experienced the same type of theft by law enforcement.
We expect a criminal to be a thief. We don't expect police to be thieves. But they often are.

"Dateline NBC" did a piece on police officers who stop out-of-state drivers who were driving expensive cars. The "Reasonable Suspicion" for the stop is "Unsafe Lane Usage" or "Speeding." All fabricated. They then seize the car and its contents under the "Drug Forfeiture Law."
They'll keep any cash or valuables they find in the car, claiming it was "Proceeds From Drug Sales." Under the guise of "The War On Drugs."
They'll take the car to a shop & completely dismantle it, searching for hidden drugs. When they don't find any, it's just "Too Bad" for the car's owner. They won't return any of the cash or valuables due to "Continuing Investigation."

The show's producers rigged a Lincoln Town Car with hidden cameras & video. The car was soon stopped on the highway & seized under Forfeiture Laws that allowed it. The video from several cameras showing the car's speed & lane usage proved the cops were lying.
When the show's producers interviewed the police chief & confronted him with the video, he said, "Well.....uh......I can't comment on an investigation that is ongoing."

I'd chat with an attorney. You didn't violate any laws. Yet are being punished for discharging a weapon legally. I'd get the news station on this, a lawyer would LOVE to be on tv to say why what they're doing is wrong. Great advertising for him, free legal for you.

Police know the attorney will charge many times what the gun is worth; that's how they get away with it.

I'm in hopes it's our stuff

After giving them the info they needed, I inquired when we'll find out
They said the process takes six to nine months for resolution

Yup, par for the course. String you along until you either give up or pay an attorney as much or more than the items are worth. With no guarantee. The perfect crime, committed by those who are sworn to fight crime.

I went to the DA’s office yesterday. I was told by the secretary, or I think she was, that she was told that if I came in asking for my property to tell me to stop coming in. The property will be returned when they no longer need it. I asked her if the case has been litigated and of course I got the usual answer, I have no idea and she wouldn’t check to find out.
