Handcuffs & Manacles

Am I the only one that wonders why when going to court, the non violent accused, well dressed, is handcuffed and in some cases manacled in addition to generally being guarded by two well armed and stalwart guards? Isn't that a bit overkill? Is there a fear that the accused forger or shop lifter, marijuana possessor, embezzler might all of a sudden become violent or is it just a way to tell who is the accused and who is the defense attorney.

My friend is the guy who transports inmates from the jail to the courthouse. Often, fights break out in his van and just imagine trying to control ten or more inmates if all hell breaks loose!

My daughter was just telling me this morning that the funeral services she attended yesterday was also attended by one of the woman`s son`s who is currently incarecerated on a drug conviction. He was shackled and handcuffed and accompanied by two Sheriff`s deputies. He was also a pallbearer (not sure how he was able to accomplish that). Bet he made his mama proud.....

I think I would like to know more about the son's crime before I, as a mother decide whether or not his deceased mother is proud of her son. Even incarcerated individuals may have a positive relationship with the woman who gave them life. He cared enough to be a pall bearer, and endure the shame of being seen in public shackled etc.

True.Don`t know what his relationship with his mom was-only know that his brother`s was really good. I did look up his arrest record. 4 felonies and 2 misdemeanors- one of which was bringing drugs into jail. $245,000 bond. That`s being a pretty bad boy. Not saying she didn`t love him and he didn`t love her,but I`m sure she wished he had chosen a different path in life.....

Question, what does being well dressed/poorly dressed have to do with a propensity for violence? Seems a tad elitist to me.

How the accused is dressed doesn't have anything to do with their propensity for violence, but what they are being accused of does. Forger vs. Armed Robber. The forger would probably appear in court wearing a suit or jacket and the Robber in orange colored jail garb. Get It?

No-one should have to appear at their trial in orange prison garb. It is prejudicial.
Most accused over here are out on bail anyway so the question of manacles doesn't arise.
They come to the court with their legal representative.

Dangerous accused who are denied bail are accompanied by armed guards but are not usually manacled in the court.
I was in court once where 4 men were accused of multiple armed robberies. There were contained in a space at the side of the court behind bullet proof glass and each man had an armed guard seated behind him. They were very scary looking men and I have no recollection of what they were wearing. I was glad I didn't make it onto the jury that day so I never did see what happened during the trial.

They don't appear at trial in jail garb but they do for hearings and other court appearances.
For trials everyone is dressed in their Sunday Best.
