Jail time for Jussie Smollett?

No one said it's ok. The accuser got hers and, in an unusual move, the prosecutor got his as well. How often does that happen?

When I was in law school 4 decades ago we had quite a number of privileged white suburbanite students who denied there was ever any such thing as racism. They would say something like, this is America - there is no racism here except in the imagination of a few trouble making people. Whenever any person of a minority background told stories of suffering discrimination (whether personal experience or that of people related to them) these skeptics dismissed those cases as freaks of nature or as being made up stories.

One day a study group of 5 or 6 students (all white suburbanite) were discussing racism. I was invited to join them when a white girl started to talk about an incident she read of in her research on racism. It was as follows: somewhere in the South a white woman called the police to say she had been raped by a naked black man. In her despair she did not get to see his face but did see his body. She could only identify him by that. The police had no trouble buying her story that she had been raped by a naked black man who stormed into her house. They rounded up every black man they could find and beat up those who refused to take off their clothes. After a few hours of repeated questioning of these guys, each of them having a perfect alibi, and everyone wondering how could a naked black man roam around a white neighborhood naked without anyone else seeing him, the cops managed to get her to admit that she had not been attacked. She made up the story because of her hatred for black men. When the other students heard this they were aghast. Unfortunately, time was up and we all had to get to the next class so I never got to find out what (if anything) happened to that racist white woman.

Bear in mind that the historical record clearly shows innocent black men have been lynched for similar made up attack claims.

Right now as we are exchanging these ideas there are still hundreds, if not thousands, of innocent black men in jail for crimes they did not commit here in the USA. Like it or not, this is the truth and nothing but the truth.
 
From what I understand there will be mandatory penalties for each count he was convicted of. Question is, will they run concurrently or consecutively? Will the jail time be suspended? Will he be allowed to wear an ankle monitor? Will there be probation? Will this be tried again and waste more taxpayer money? How long will his funds hold out to pay the attorney?
Personally, I don't think there will be an appeal. His lawyers would have to find grounds for an appeal and that is unlikely, in my opinion. Hopefully, he will be made to pay the $100k + that was spent on this investigation.
A couple more more concerns. Will this conviction get him more work? Will it be a badge of honor? California acts like another country when it comes to the law and because they are so liberal, criminals get away with all manner of crimes.

When I lived in the SF area many years ago, I was standing waiting for a bus and a wino (yes, it was evident) came up behind me and pinched my bottom. He laughed and had crumbs all stuck in his stubbly face. What a picture! The man was homeless and I did not have the heart to report such a minor incident. I laughed it off and laugh about it now because it was not a harmful act but over the years it seems as though crimes have escalated all over California. I will never forget this man's sparkling eyes and gleeful expression as he triumphed in front of his friends. The mess that SF is in started a long time ago. Unfortunately, I have a bigger target than previously. LOL Happily, I moved from CA several years ago.
 
I don't think he should do jail time but reimbursing for the time lost working that case would be appropriate as well as community service. It will be interesting to see what he gets. For the life of me I can't figure out why he did that dumb sh*t !

The best community service Smollett could perform would be to stay out of the community.

Even if only one objection by Jussie's team was overruled, that could provide grounds. Any guilty verdict has grounds for Appeal. The legal question would be, do they have at least some merit or just a chance the Appeals Court may side with them?
