A Simcoe, Ont. woman is facing an assault with a weapon charge after she said that she accidentally sprayed her neighbour with a water gun over the Labour Day weekend, a situation that at least one legal expert says amounts to an "unfortunate waste of resources."

Wendy Washik was at a neighbourhood barbecue on Sept. 1 when she joined a playful water gun fight with one of her neighbour’s children. As the 58-year-old educational assistant was chasing the child to the front of the home, she said she accidentally sprayed another neighbour with water.

“I just kept apologizing and apologizing,” she told CTV News Toronto in an interview on Wednesday, adding that the neighbour began “screaming” at her following the incident.

I think there is bad blood between the two
Yes, there might be a long story and "accidentally" hitting the neighbor might have really been an irresistible opportunity taken.
One thing's for sure, and I watch every episode of, "Fear The Neighbor," so I should know, once you've brought "the law" into it, things are going to escalate quickly.
 
Oh, I answered a couple calls very similar to this situation. I could resolve them without involving the courts or writing citations.

In Pennsylvania, accidentally spraying someone with a hose is not a felony and is certainly not a matter for the courts to resolve. In the worse case scenario, a citation may be issued because it’s only a misdemeanor.

Wow! :eek: I have no words for something like this.

Even if the two neighbors didn't get along, the one IMO is grabbing straws to "get even" with the other it sounds. I wonder if the woman was aware if the other neighbor had issues with her? Makes me wonder about their history.

If I was another neighbor in the area, I'd be steering clear of the one who filed charges. I wouldn't want to find myself in that ladies shoes if he decided he had a problem with me.

Besides, if you are at an outdoor party where kids are around, you expect games to be played. I always remember as a kid that some adults would join in for fun. For crying out loud, it was filled with water. Or, maybe he was related to the Wicked Witch of the West?
 
The stupid is strong in this particular case. Almost, but not quite as stupid, as road rage cases that escalate far beyond their worth.
 
She said the neighbor was mowing his lawn and was "three feet away" from her when she accidently shot him. Yeah, right. I think she's lying about the whole thing. Let her testify under oath and see what she says.
 
A report I read on this incident indicated many people on the block have had issues with the neighbour who called the cops. He apparently has a history of calling them over very minor issues. He sounds like a neighbourhood nutter đŸ€Ș
Crazy that the cops laid the charge though.

I'm surprised the Crown Attorney's office hasn't already dropped the charges. The Crown Prosecutor would likely get a dressing down by the judge if he tries to bring the case to court.

Quote from one of the other neighbours about this incident" “We all get along fine, we’re not calling the police on our other neighbours,” MacConnachie said. “It’s always the one individual who’s calling the police.”
 
I'm not a lawyer, but if someone is claiming to be 'assaulted', the police have little option, but to write it up to be settled in court. It's not the job of the cops to judge the worthiness of a case.
For someone to pursue legal proceedings to redress the "trauma" of getting accidently squirted by water, proves the accuser is a crank.
Case dismissed.
 
This reminds me of the time I was stuck in traffic waiting for the light to change and some guys were washing equipment next to the road in front of a business. One guy dropped something, the guy with the hose turned to stop it from rolling away, my passenger window was all the way down, and my kid and I got a good spray from the hose. Poor guy's mouth fell open, I laughed, the kid laughed, by then the light changed and off we went before he could say sorry.

That sounds like such B.S. He was mowing his lawn and she shot him in the chest at close range. She claims she was fiddling with the water gun and accidently shot him. Riiiiiigght.

The problem with these stories is, the press never follows up on them — probably because it's not profitable. We'll never find out what happens during the trial. They got their clickbait story out and they don't have the resources to report on the trial of such little significance.

You know if it goes legal the lawyers might just have the perfect way of resolving the issue.

This happened in Canada. It won’t be going to court. If by some fluke it does, it’ll take years.

If anyone needs their asses kicked, it’s the cops who didn’t interview the others.

(PS, if you want to murder someone, do it in Canada. That’s an old comedic joke.)
