UK; Man Found Not Guilty Of Sex Crime Must Notify Police Of Sexual Activity 24 Hours In Advance

Apparently it's an enforceable law with a 5 year prison sentence for failure to comply. If the police think the guy is a predator then run surveillance on him. It's too Minority Reportish

Thanks. I suspect there is more to this than is at first apparent.

Reading between the lines, I suspect the subject has a history, and I will be surprised if he/she is not already on our Sex Offenders Register, and these new restrictions are additional to some already imposed

The granting of anonymity (in criminal cases, not civil ones) is quite unusual in the UK and is normally only granted where there is a serious risk of an unfair trial if the history should become known..

I dont think he cant be on the Offender's List, Laurie, as it states that he has not been convicted of any sexual crime. But this is a strange order. It seem unenforceable. How can they check if he has accessed the internet or used a mobile device? This is a weird one and I have never heard of it. Maybe it does not apply here in Scotland.

See in the US it is messed up, if you get frisky with your girlfriend. She is 16 and you're 18. Two years and different states yup they can label you a "sex offender" for life.

" it states that he has not been convicted of any sexual crime."

I think in this instance that means, in legalistic journalspeak ".......... during the current proceedings".

Journos are very wary of anonymity orders, which is probably why this has not been widely reported in the UK.

If they reported he was on the list he could easily be identified locally as the list is a matter of public record. That means contempt and instant jail without the without the bother of any sort of due [rocess and without the judge having to give any indication of duration of sentence! Judges are insanely jealous of this right and editors are rightly very nervous!

If his lawyer was desperate not to have his previous history come out he would be straight before the ECHR claiming " cruel and inhuman punishment".

That seems a bit extreme. :( I was aware of the 18 limit in the States but was not sure if it was every state or how seriously they applied the rule/law. Kinda 'devalues' the sex register to some extent if it becomes full of experimental teenagers.

Update

Reporting restrictions have now been lifted

http://www.bbc.co.uk/news/uk-england-york-north-yorkshire-36666966

His name has also been given in one report I read, so one of the purposes of the order has been achieved!

Sexual offenders, even if unconvicted, receive wide local publicity over here, and and many people can go to the local police station and find out if there are any predators in the area, very handy if you are buying a house, or your child has been offered a place in a local school.

Might sound a bit dodgy for unconvicted suspects to be treated this way, police still have to convince a judge, not so contrary ad a jury, and most stuff in the hands of judges is pretty safe.

Our Judiciary are totally independent of the Legislature and they guard this jealously. They can only be removed from office by both Houses of Parliament independently petitioning the sovereign, and that's only ever happened once, in 1831, so they're generally regarded as pretty reliable!
