Will ICJ’s ruling today lead to a cease-fire in Gaza?

Regardless of your personal opinions on this conflict, I feel it's an important issue to discuss because of the potential ramifications the court's ruling could have on the international community. Palestine is a mess, and needs humanitarian aid. I feel like the ICJ will rule for a temporary cease fire which will include the release of some Israeli hostages. Possibly a month, but maybe shorter than that. I wonder if they will announce if they are going to take on the long process of the accusation of genocide. It will take a couple years.

It is getting complicated with other nations getting involved. What ever the ruling I hope we can proceed withfinding a way to stop the killing, especially the innocents.

While ICJ decisions are legally binding and cannot be appealed, the ICJ only maintains authority over U.N. members, or nations that accept its authority through some other mechanism, like a clause in a treaty. Since South Africa and Israel are both U.N. members, any decision would, in theory, be binding.

But multiple countries have ignored ICJ decisions. In 2022, Russia ignored a court order to stop invading Ukraine. The U.S. has ignored at least two ICJ orders, the first, in 1986, when the ICJ ruled that U.S. support for the right-wing Nicaraguan rebels, the contras, was illegal, and the second, in 2018, when the court demanded the U.S. make exceptions in its sanctions on Iran.

Hamas said if the ICJ orders a cease-fire, the group will abide by it if Israel does.
How has the ICJ ruled on previous requests for provisional measures?
 

The International Court of Justice (ICJ) has ruled that it will not throw out South Africa’s case against Israel, which alleges genocide in Gaza 12. The court found that South Africa has sufficient basis to pursue the case and rejected Israel’s application to have the case thrown out 12.

There was a lot of detail there. Here are the provisional measures the court has made:

  • 1. Israel must take all measures to prevent any acts that could be considered genocidal - killing members of a group, causing bodily harm, inflicting conditions designed to bring about the destruction of a group, preventing births
  • 2 Israel must ensure its military does not commit any genocidal acts
  • 3 Israel must prevent and punish any public comments that could be considered incitement to commit genocide in Gaza
  • 4 Israel must take measures to ensure humanitarian access
  • 5 Israel must prevent any destruction of evidence that could be used in a genocide case
  • 6 Israel must submit a report to the court within one moth of this order being given
The court also expressed grave concern about the fate of hostages being held by Hamas and called for their immediate release.

The other night on the news a 12 year old boy was caring for 6 siblings including a baby that was probably only 6 months old. Both parents were dead and a neighbor gave him formula but the baby wouldn’t drink it and just cried. The poor boy said all he wanted to do was to go back to school. It’s heartbreaking. They are showing much less of the slaughter on TV now and I am sure it’s because people are changing their minds about what is happening.

While Hamas started the violence Israel has killed 25k Palestine people mostly women and children. Any hostages with medical conditions are probably dead even if they managed to escape the bombing.

Like usual governments on both sides make decisions that their citizens must pay for with their lives. It was no different during Vietnam where the people in the senate, congress, etc didn’t send their kids to fight the war and die.
 

Be careful, the first time the Gaza Israel situation was raised here in a thread, some posters who gave a more rounded and balanced view were ostracised by some and had their posts deleted. Oh how things have changed.
