Six months' jail for man who put his hand up schoolgirl's skirt on crowded tram

The girl objected very loudly rather than just running away covered in embarrassment. Good for her.

A man who sexually assaulted a schoolgirl by putting his hand up her skirt on a crowded tram has been jailed for six months.

Magistrate Jonathan Klestadt said Marshall Jordan's "lewd conduct" had the potential to reduce the perception of safety of Melbourne's public transport network among children and parents, and found there was no other option than to send him to prison.

Jordan, 31, was in August found guilty of performing an indecent act on a child under 16 after a three-day hearing in which he denied touching the girl.

Melbourne Magistrates Court was told Jordan was on the 86 tram in Northcote on May 4 last year when he touched the 14-year-old, who felt him put a hand up her skirt as she prepared to get off the tram.

She turned to him and yelled: "How dare you, you bloody bastard." Jordan responded he did not do anything, the court was told, and got off the tram and attempted to change his appearance by removing a jacket and putting on gloves.

Mr Klestadt on Wednesday found that by altering his appearance, Jordan understood the significance of his actions, before he continued on to work at the Departmemt of Immigration and Border Protection.

I remember hearing a story told about a young woman sitting on a train who felt the hand of the man sitting next to her on her thigh. She seized him by the wrist and held it high in the air while asking in a very loud voice, "Does anyone own this? I just found it on my thigh." He left the carriage but would that stop him from trying it on some other woman? Probably not, which is why the magistrate decided on a custodial sentence.

Groping is sexual/indecent assault and it is criminal.

I'll tell you what weird thing happened when we were in the middle east in Jordan. Me and a couple of my daughters were on this bus. The bus had stopped in a bus parking lot to load passengers. This middle aged man with a coat on opened his coat and his member was hanging out and he rubbed it against my daughter who was a teenager then. She opened up a whoop a%s can of martial arts all over that man. The fight ensued as he tried to escape the bus into the parking lot and she was still giving him an as% whooping. A crowd was gathering and men were laughing at the man who was getting his butt kicked. Two policemen came and pulled my daughter off the guy and asked her what happened and she told them and they hit him bloody with sticks and put him in their police car and drove off. It was one heck of a freaky experience. I asked my daughter if she was okay and she just said " Nasty bas%ard ! I want to cave his face in!"

Don't knock yourself over the decision you made. When these things happen it throws someone into a sort of shock. A large chunk of the brain is really just frozen in the shock of the unexpected. You were a victim & no blame is on you for the act or the decision you made following it.

I have to hand it to these girls for reacting to these predators, yet I wonder how many go unreported. It's even difficult and embarrassing for adults!

See that's what I love about New Yawk and surrounding areas. If a man was acting inappropriately towards any woman...the first announcement would bring a large pack of women...men too...in her defense. Lucky if they leave enough for the police to arrest.
