Aunt sues 12-year-old nephew for $173,000 for accidentally breaking her wrist while greeting her

AN aunt is suing her 12-year-old nephew who accidentally broke her wrist while greeting her — because she now struggles to hold a plate of canapés. Jennifer Connell, 54, claims she fell and hurt herself when Sean Tarala, excited to see her, leapt into her arms at his eighth birthday party four years ago.

Despite admitting she loves the youngster, who has always been “very loving, sensitive” toward her, the New Yorker wants him to cough up $US127,000 ($173,000) in damages.

“I live in Manhattan in a third-floor walk-up so it has been very difficult. And we all know how crowded it is in Manhattan,” she told a Connecticut court on Friday. “I was at a party recently, and it was difficult to hold my hors d’oeuvre plate.”

Connecticut Post reported Sean, whose mother died last year, looked confused in court as he sat beside his dad, Michael Tarala.

The court heard Connell attended Sean’s birthday party at his Connecticut home on March 18, 2011. When the pre-teen saw his aunt, he ran toward her, exclaiming, “Aunty Jen, Aunty Jen.”

“All of a sudden he was there in the air, I had to catch him and we tumbled onto the ground,” Connell, who doesn’t have children, testified. “I remember him shouting, ‘Aunty Jen, I love you,’ and there he was flying at me.”

The human resources manager said she didn’t complain about her injury at the time because she didn’t want to upset Sean. But now she claims her life has been turned upside down.

“The injuries, losses and harms to the plaintiff were caused by the negligence and carelessness of the minor defendant, in that a reasonable eight-year-old under those circumstances would know or should have known that a forceful greeting such as the one delivered by the defendant to the plaintiff could cause the harms and losses suffered by the plaintiff,” Connell’s bizarre lawsuit claims.

A six-member Superior Court jury will decide on the lawsuit.

This is ridiculous. A perfect example of a "frivolous lawsuit". It happens all the time, all over the world.

Lawyers and their plaintiffs so greedy. When insurance companies deny claims or offer less than they want, they file suit. It's usually against the insurance company.

She lives in a 3rd floor walk up in Manhattan? This gal must have mega bucks!
 
Insurance is most likely involved, so she will probably collect. Otherwise I doubt she would bother. It's all about $$$$$.
 

Has she lost her mind????? He was just being normal and was happy to see her because he loved her. After this, I doubt he will then and I couldn't blame him! Her lawyer is just as bad as she is for taking such a stupid and heartless case!!!! If she really cared about him, she wouldn't be doing this to him. This makes me so angry!!!!!
 
The boy lives in Westport CT, a typically very wealthy suburb, just a short hop from NYC. His family are probably quite wealthy too, which is motivating the greedy lawyer and his greedy client.

It's a shame she has was seems to be permanent damage, but there was no malice aforethought, or even any negligence on the part of the boy...who was just being a kid.

If this lady can't afford her pricey NYC digs anymore, maybe it's time to move.
 
Wealthy people usually get lots of insurance. As I said, that's probably what it's really about. Boy's family may have even worked it out with her.
 
This is obviously just a ploy for the family's insurance company to pay for her injuries. There have been many cases of husbands suing wives and vice versa to get insurance payoffs. I read about one last winter where a wife was suing her husband because he neglected to put down salt on the icy sidewalk and she slipped and broke something. I did not read about the outcome.

Talking about funny lawsuits (this is probably apocryphal but amusing nonetheless): A man in Atlanta bought a large number of hideously expensive cigars and insured them. He proceeded to smoke them and then submitted a claim to his insurance company on the basis that they had thus been" destroyed by fire". The insurance company then informed him, in that case, that they would be filing charges of arson against him. I'm sure everyone had a good laugh and sent their lawyers home.
 
Unbelievable....no, I'd never sue my nephew in a case like that...the woman has issues and I don't think it's all money related.

I don't think there's any doubt about it. There's a general "You can get money for that" attitude in a large segment of our society. They think they are being clever, and "why not", no one loves the insurance company. Unfortunately, the insurance companies just passes it through to us by raising premiums. That's one of the main reasons we are all paying through the nose for our auto and home insurance, not to mention what malpractice suits are doing to our medical system.
 
Reminds me of a cousin I had. Little beast was so hyperactive he was always breaking this or that. Himself included. I have no idea how old I was, he was about 7 so I would be about 10. He had his arm in a cast for the second or third time. He leaped at me to try to swing with the cast and I ducked. Son of a gun, he re-broke it. Glad his parent's can't sue me now.
 
Regardless of who she sued, she made that poor little boy feel so bad. I can't help but feel so bad for him AND his Dad.

Nothing more than the bills she accrued for treatment. The insurance company offered her $1 and told her to go away. All she could do was bring suit.

And in her nephew's State of residence, no one can sue an insurance company [ migod, that sounds more like Texas than a State in the East! ], they can only sue an individual.

And so that's what she did.

If you read through the article, she and the family are still on good terms.

Yes, and like I said, a headline screaming "woman sues her 12 yr old nephew" gets people all riled up. Even though that is NOT what happened.

Heck, if this happened to me I would certainly want my medical bills paid! It's a safe bet that eveyone spitting on this woman would feel the same way. Since when does wanting to get medical bills paid for an accident make someone a bitch? (or a son of one)? Guess there are a lot of bitches and SOBs filing claims with their insurance companies to get their medical bills paid. Shame on them.

What on earth does any of this have to do with (the assumption of) her nor being able to afford her Manhattan apt?!! And how does anyone know that she made the boy feel bad? Sounds nice to say "I feel so bad for that poor little boy", but for WHAT? :confused: Is the "poor little boy" even remotely aware of the process? Wow, talk about pulling things out of the air.

One news story I saw started out with "Wow. Wonder how the holiday dinners will be in THIS family." I also see a similar comment here. Well, the holiday dinners will be just fine, so no need to worry.
